국문 초록

디지털 시대의 발전과 금융 시스템의 글로벌화는 범죄 환경에 근본적인 변화를 가져왔다. 특히 가상화폐, 비대면 거래, 국제 금융 네트워크의 확산은 범죄 수익의 은닉과 세탁을 정교하게 만들었으며, 보이스피싱과 같은 조직적 사기 범죄는 피해 회복을 어렵게 하고 있다. 한국의 형사사법 체계는 전통적으로 민사와 형사를 엄격히 분리하여 피해 회복을 피해자 개인의 책임으로 두고 있으나, 이러한 구조는 디지털 시대의 새로운 범죄 양상에 적합하지 않다. 본 연구는 디지털 시대의 범죄 특성을 반영하여, 범죄 수익 동결 및 보전제도의 현황과 한계를 분석하고, 이를 보완하기 위한 대안을 제시한다. 특히, 긴급 동결 제도의 도입 필요성, 국제 공조의 확대, 그리고 피해자 보호를 위한 몰수보전 및 추징보전 제도의 개선 방안을 중점적으로 논의한다. 이러한 제도적 정비는 단순히 범인을 처벌하는 데 그치지 않고, 피해자의 신속한 권리 회복을 실현하며 형사사법 체계의 새로운 패러다임을 구축하는 데 기여할 것이다.

영문 초록

The development of the digital age and the globalization of the financial system have brought about fundamental changes to the criminal environment. In particular, the spread of cryptocurrency, non-face-to-face transactions, and international financial networks has made the concealment and laundering of criminal proceeds more sophisticated, and organized fraud crimes such as voice phishing are making it difficult to recover damages. The criminal justice system in Korea has traditionally strictly separated civil and criminal matters, leaving the recovery of damages to the responsibility of the individual victim, but this structure is not suitable for the new criminal patterns of the digital age. In particular, the spread of cryptocurrency, non-face-to-face transactions, and international financial networks has made the concealment and laundering of criminal proceeds more sophisticated, and organized fraud crimes such as voice phishing are making it difficult to recover damages. This study analyzes the current status and limitations of the crime proceeds freezing and preservation system in light of the characteristics of crime in the digital age, and proposes alternatives to complement it. In particular, the study focuses on the need to introduce an emergency freezing system, the expansion of international cooperation, and the improvement of the confiscation and back-tax preservation systems for victim protection. Such institutional reforms will not only punish criminals, but also contribute to the rapid restoration of victims’ rights and the establishment of a new paradigm for the criminal justice system.
