국문 초록

현대사회는 과거에 비해 경제규모가 성장했고 그만큼 보험가입금액 또는 담보 범위가 다양해지고 시장의 대형화가 이루어졌기 때문에 손해 발생의 원인이 복잡해졌다. 이러한 상황에서 정확한 면책, 부책의 판단, 손해액의 계상 그리고 공정한 보험금액의 결정 등은 매우 중요한 업무이며 이에 따라 손해사정의 기술성 및 전문성이 점차 고도화 되어가고 있다. 손해사정은 일차적으로는 보험금 청구권자의 피보험 이익의 실현을 위해 중요한 업무이며, 보험회사의 경쟁력 확보뿐만 아니라, 보험료의 산정기준을 제공하고, 공정한 기준을 통해 보험산업 내 도덕적 해이를 방지할 수 있다. 따라서 이 연구는 손해사정사제도에 대한 개념을 알아보고 실태를 살펴봄으로써 문제점을 도출해냈다. 구체적으로 우리나라 손해사정사제도의 현황과 손해사정사와 관련된 국내 법률을 고찰하였다. 그리고 해외 손해사정사제도를 검토해봄으로써 시사점을 제시하였다. 이 연구는 손해사정사제도의 개선점으로 첫째, 업무의 독립성을 제고하기 위한 손해사정사의 권한부여 및 법적 보호체계 등을 세분화하여 제시하였다. 둘째, 손해사정사의 전문성 제고를 위해 자격제도의 강화 및 보수교육 도입을 제시하였다. 특히, 손해사정사 업무의 통합을 주요 골지로 시험과목 및 인정 제도의 강화, 보수교육 및 면허갱신제도 도입을 주장하였다.

영문 초록

In modern society, compared to the past, the economic scale has grown, resulting in greater diversity in insurance coverage and an expansion of the market. Consequently, the causes of losses have become more complex. In this context, accurate determination of liability and indemnity, as well as the fair assessment of insurance claims, have become crucial tasks. As a result, the technical expertise and professionalism of claim-adjuster(CA) are continuously evolving. Claim adjustment primarily serves to realize the insured's interests for insurance claimants. It also plays a pivotal role in securing the competitiveness of insurance companies and providing a basis for determining insurance premiums, ultimately preventing ethical misconduct within the insurance industry. Therefore, this study examines the concept and current status of the loss assessment system, highlighting its issues. Specifically, the study explores the existing CA system in South Korea and relevant domestic laws. It also reviews international CA systems to provide insights. The research proposes several improvements to the CA system. Firstly, it suggests enhancing the independence of CA through a detailed delineation of their authority and the establishment of a legal protection framework. Secondly, it advocates for the enhancement of the professionalism of CA through the strengthening of qualification systems and the introduction of continuous education. Notably, it emphasizes the consolidation of loss assessor functions, focusing on strengthening examination subjects and recognition systems, introducing continuous education, and implementing license renewal procedures.
