국문 초록

북한의 핵무기 개발 및 보유 가능성과 관련하여 ‘선제적 공격’이 필요하다는 논의가 적지 않게 제기되었고, 이에 대한 찬반의견이 표출되는 가운데, 천안함 사태를 맞자 능동억제개념이 태동하게 되었다. 선제공격의 개념이 핵 상황 뿐 만 아니라 재래식 국지제한전 상황에도 확대 적용하게 된 것이다. 우리의 대북 군사전략이 이처럼 고차원의 선제성을 지향함에 따라 현 시점에서 이에 대한 적법성 및 적절성을 다면적으로 심층 검토해 볼 필요가 있게 되었다. 이 글은 이러한 배경에서, 우선 선제공격과 관련된 용어에 대한 정의 및 개념을 정리하고, 선제공격의 국제법적 의미를 찬반 양면에서 살펴보았다. 또한 북의 핵위협 상황에서는 자위권의 일부로서 선제공격이 불가피함을 전략적 차원에서 검토하였다. 끝으로 능동억제의 적절성여부를 평가한 다음, 예방적 자위권적 선제공격의 능력과 의지를 개념적 차원에서 제시했다.

영문 초록

While the DPRK's potential possession and development of nuclear weapon have sparked an intense debate over the necessity of preemptive attack, the sinking of Cheonan led the ROK to coin “proactive deterrence.” Proactive deterrence suggests that a preemptive attack might be applied in imminent conventional, limited war threat as well as nuclear threat. As our military strategy against the DPRK pursues such strong preemption, it is now required to review and verify its legitimacy and suitability in multidimensional ways. In this paper, we first seeks to clarify the definition and concept of several terms relevant to preemptive attack, and then review its implication for international law with each perspective of the pros and cons. In addition, we found that preemptive attack, as part of the right of self-defense, is indispensable in the situation the DPRK threats ROK with its nuclear weapons. At last, after assessing the legitimacy and suitability of proactive deterrence, we present the ROK's willingness and capability of anticipatory self-defense preemptive attack in a conceptual manner.
