국문 초록

정신질환 범죄자의 지속적인 증가와 높은 재범율로 인해 현행 정신질환 범죄자를 대상으로 한 시설 내 처우의 효과성에 의문이 제기되고 있다. 또한, 정신질환과 범죄라는 복합적인 문제에 대해서 형벌중심의 개입이 아닌 치료중심의 다양한 접근들이 시도되고 있다. 특히, 정신질환 범죄자의 성공적인 재활을 위해 지역사회통합의 개념이 점차 강조되고 있는 상황이다. 하지만 선행연구는 정신질환 범죄자의 처우와 관련하여 치료와 지역사회통합을 이론적 개념적으로만 다룰 뿐, 기본 원칙이나 사례연구를 통해 종합적으로 다루지 못한 한계를 가지고 있다. 이에 본 연구에서는 정신질환 범죄자의 성공적인 재활을 위해 다차원적인 지역사회통합에 대해 논의하고자 하였다. 또한, 해외사례를 바탕으로 정신질환 범죄자의 성공적인 지역사회 재활을 위한 구체적인 방안을 제공하고자 하였다. 이를 위해서 본 연구는 국내 정신질환 범죄자 처우 현황 및 문제점과 지역사회 통합의 다차원적 개념에 대해서 논하였다. 또한, 해외 사례 분석을 통해서 지역사회 통합을 위한 8가지 원칙을 제시하였고, 실제 지역사회 기관 및 교정시설에서 제공하는 프로그램들을 소개하였다. 마지막으로 정신질환 범죄자의 성공적인 지역사회 통합을 위한 과제에 대해 논하였다.

영문 초록

An increase and high recidivism rate among offenders with mental illness bring the questions about the effectiveness of institution-centered approach. In addition, there are is various approaches focusing on treatment rather than punishment to deal with complicated issues related crime and mental illness. In particular, the concept of community integration has been emphasized for the successful rehabilitation of offenders with mental illness. However, previous studies only treated this issue in a theoretical and conceptual way without comprehensive understanding using critical principles and practical examples. This study aimed to discuss multidimensional community integration for the successful rehabilitation of offenders with mental illness. Further, we suggested specific and applicable solutions for successful community rehabilitation by introducing examples of other countries. This study discussed the statistics, problems of current approaches for offenders with mental illness in Korea, and the multidimensional concept of community integration. We also provided 8 principles for community integration based on the analysis of foreign case study and introduced various programs in correctional facilities and community agencies. Last, we discussed about tasks for successful community integration of offenders with mental illness.
