국문 초록

갈수록 심각해지고 있는 소년범죄의 예방과 효율적인 대책마련이 중요하고, 이에 대하여는 성인범죄자와 달리 다르게 처우해야 한다는 국친사상에 바탕을 둔 소년사법의 정책과 논의가 적극적으로 필요하다. 범죄통계자료에 대한 객관적인 분석과 해석이 필요하지만, 이를 일반화하는 것은 현실에 맞지 않은 측면이 존재한다. 성인기로 가기 전단계에서 청소년들에게 가장 중요한 부분은 가정환경과 학교교육일 것이다. 가정환경에서는 부부관계가 자녀에게 미치는 영향이 크고, 부모의 자녀에 대한 사랑 등이 전제될 때 학교교육에서는 민주적인 책임감이 있는 사회인으로 성장하기 위해서 인성교육이 필요할 것이다. 우리나라 교육제도하에서는 대학입시 등 경쟁구도에서는 학교현장에서 교사의 역할도 중요하지만 천성적으로 주어진 재능을 찾고 이를 통하여 진로를 설계하고 이에 맞는 직업을 선택하도록 지도하는 것이 바람직할 것이다. 최근 회복적 사법논의 및 모델 등이 선보이고 있는 측면에서 이를 소년사법제도에 응용하여 책임감을 갖게 하지만 과거 부정적인 경험을 해소하고 치유하는 시스템 마련이 정책적으로 필요할 것으로 보여진다.

영문 초록

Recent statistics on juvenile crime and practical discussions surrounding its characteristics agree that unlike adult offenders, juvenile offenders should be treated differently. However, the most important part in reality is the home environment and personality education in the school field. In the meantime, we need to listen to various educational achievements of South Korea, especially through education based on university entrance exams and competition, but most of all, it is important to restore credibility in public education because it is an educational system that finds talents of South Korean students early on. We have looked at the characteristics and trends of juvenile crime in recent years. Looking at its characteristics, the juvenile crime is getting worse day by day and shows results that are never inferior to the recidivism rate of adult crime, so our society needs to reflect on whether it is doing a good job of dealing with juvenile crime. It is important to prepare an effective countermeasures against juvenile crime through correctional treatment. It is also necessary to be fully aware of the various institutional problems that arise in the process of dealing with juvenile crime and to come up with policy alternatives to them. There is also a need to look positively at the serious discussion of the Restorative Prison Project, which gives a sense of responsibility for crime and heals a negative experience. Therefore, the vicious cycle of juvenile crime will not be broken and serious discussions surrounding the fundamental causes of juvenile crime will be needed, as well as the continuous attention and activities of institutions and adults, and policy efforts will be needed in these areas. Adolescents in the 21st century are our future. As a precursor to becoming an adult, it is necessary to make a holistic effort to discover the dreams and talents of young people in the welfare state early, design career paths, and have a job as well as in homes, schools, and communities.
