국문 초록

우리 헌법은 종교의 자유를 보장하면서 정교분리를 규정하고 있다. 종교를 기반으로 설립된 사립 중고등학교에서 종교교육의 자유가 인정되지만, 공교육체계에 편입되고 중등학교 평준화가 실시되고 있는 우리나라 현실에서는 학생의 소극적 종교의 자유 보장도 중요한 문제이다. 우리나라에서는 이 문제를 종립 중등학교의 종교교육의 자유와 학생의 소극적 신앙의 자유 간의 기본권 충돌로 이해해 왔다. 한편 최근에는 이와 관련한 대법원 결정이 이 문제 해결을 위한 일정한 기준을 제시한 바 있다. 본 논문에서는 이러한 상황을 배경으로 하여 학생의 신앙의 자유와 종립 중고등학교에서의 종교교육의 자유의 조화 방안을 연구하였다. 이를 위하여 학생의 종교의 자유와 종립 학교의 종교교육의 자유의 보장 범위를 살펴보고 기본권 충돌로 문제가 발생할 수 있는 영역을 법적으로 분석하였다. 그리고 이러한 기본권 충돌의 해결 가능성과 대법원 판례의 의미에 관해 분석하였다. 끝으로 학생의 신앙의 자유와 종립 학교의 종교교육의 자유가 조화를 이룰 수 있는 방안을 현행 제도 하에서의 종교교육 운영 방안과 제도적 보완 방안으로 나누어 모색하고자 하였다.

영문 초록

The Korean Constitution guarantees the freedom of religion but also prescribes the separation of politics and religion. Private middle and high schools established based on a certain religion has the freedom of educating their religion, but it is also important to guarantee the ``passive freedom`` of religion of students in the reality of Korea which places students in the public education system, and the standardization of middle and high schools has been conducted. In Korea, this issue has been understood as the conflict of natural rights between the passive freedom of religion of students and the freedom of religion-based secondary schools in educating religion. In the meantime, a recent decision of the Supreme Court suggested a certain yardstick for addressing this issue. Accordingly, this paper studied for a solution to find harmony between the religious freedom of students and the freedom of religion-based schools to educate their religion. For this, it examined the scopes of guarantee of both the freedom of students and the freedom of religion-based schools to educate religion, and analyzed from a legal perspective the areas where problems could occur due to the conflict of natural rights. In addition, this paper analyzed the possibility of resolving such conflicts of natural rights and the significance of the precedent made by the Supreme Court. Lastly, it tried to seek for a solution to harmonize the religious freedom of students and the freedom of religion-based schools to educate religion.
