국문 초록

2003년 UN에서 우리나라에 ``학생의 표현, 결사의 자유를 침해하는 교육부 지침과 학교교칙 개정``을 권고하여 국가보고서(2008년)를 제출하면서 학생징계절차의 확립과 학생 참여방안에 대한 관심이 증폭되었다. 이후 2010년 6월 2일 지방선거에서 이 문제가 정치적 쟁점으로 형성되었고, 2010년 경기도 교육청에서는 학칙개정이 조례로 이루어졌다. 이 문제와 관련하여 본 연구에서는 단위학교 학생생활 규정 실태와 내용을 조사, 분석하였다. 또한 학생생활규정의 제·개정절차의 문제점과 법률의 관계를 규명하고자 하였다. 학생징계절차의 민주화와 투명성 보장은 무엇보다 올바른 교육제도의 수립으로 이루어져야 하고, 그에 따른 교육과정의 반영, 학생인권의 보장, 학생참여, 교원의 의식 변화는 교육정책으로 뒷받침되어야 한다. 따라서 학생징계 절차를 개선하고 학생들이 능동적으로 참여할 수 있는 방안을 제안하고, 향후 각 시도 교육청과 지방의회에서 제·개정할 학칙의 기준과 법적 당위성을 제공하고자 한다.

영문 초록

School is a place of education. First and foremost, the democratization and the guaranty of transparency in student disciplinary process should be based on the establishment of correct education and education system. An urgent question are related to the reflection of education process, the reinforcement of education on human right, and the institutionalization of student participation. The change of awareness in teachers is also required. The goal of education on human rights should be met with the principle like that All men are endowed by their Creator with certain unalienable Rights of basic human rights and freedoms. The state is prioritize the duty of protecting the weak, whose rights are easily infringed upon and thus foster the ability to live in justice. This concept is originated from the promise of the world by the way of UN, and Korea should observe the subject as a member of UN. As this study became known, the real situation of school and guidance regulations in Korea revealed various shameful aspects within these systems; teachers are constantly indifferent, and students are isolated and their parents are assuming the attitude of an on-looker. Although students` human rights are not separated from the educational authority, school regulations and student disciplinary regulations are created and managed completely under the command of the system. Regarding students as the subject of immature control and a method to elevate the school`s prestige by sending more of them to universities underlies this state. In consequence, a school does not put great emphasis on the protection of human rights for students, demonstrating that awareness problems are behind the problem. Considering these points, the efforts of government and each school should be accomplished continually. The government is suggested to make efforts to distribute manuals and guidance materials regarding the Rights of the Child, such as a cartoon, in order elucidate its points effectively. Most importantly, the government should not be hesitant in creating the system in which the students are not only acknowledged as center of school life but also voluntarily participate in school operations. In other words, juvenile human rights are achieved not by giving benefits but by confirming one`s various rights.
