국문 초록

이 논문은 2010년 개정된 지방교육자치에 관한 법률에 근거한 교육감 선거제도의 규범적 타당성과 사실적 실효성을 진단한 연구이다. 연구대상은 2010년 2월 개정된 지방교육자치에 관한 법률과 이에 근거하여 6월 2일 지방선거와 동시에 실시된 전국 16개 지역의 교육감 선거 과정 및 결과이다. 제도의 규범적 타당성에 관하여는 헌법정신 및 지방교육자치 원리에 입각하여 헌법재판소의 판례를 비롯한 쟁점 사안을 검토하였다. 사실적 실효성에 관하여는 법률과 제도현실간의 간극을 입법취지와 선거결과와의 비교분석을 통하여 논하였다. 쟁점으로는 주민직선제의 존속 여부, 교육감 후보 자격제한 문제, 선거운동 상의 제약 등에 관하여 다루었다. 시도지사 러닝메이트 및 임명방식은 헌법 적합성이 취약하며, 교육감의 권한이 재조정 되어야 하고, 선거방식의 개선은 나름대로 효과가 있었으나 근본적으로는 체감자치의 실효성을 확보하기 위해 주민의 자치의식을 높여야 한다는 것이 결론이다.

영문 초록

The purpose of this study is to review the results and issues of the ``norm validity`` and ``actual effectiveness`` at the direct election system of the superintendent in 2010. According to the constitutional court (99 hun-ba 113), the constitutional essence of the local education autonomy system is to harmoniously guarantee the three value of democracy, local autonomy, and independency of education. And it`s legal basics is in the article 31④ of constitution. The typical four principles of the local education autonomy system mean ``decentralization of educational power``, ``control by residence``, ``educational independence``, and ``management by Specialist``. Lately added principle is ``economical and social efficiency``. At the chapter Ⅱ, this article analyzed the constitutional basic of the superintendent election and the history of election system from 1949 to 2010. The political goal of co-election of superintendent and mayors and governors is summarized as a ``low-cost and high-efficiency election system``. but people has little interest in the superintendent election. At the chapter Ⅲ,Ⅳ, this article discussed the problem of the ``norm validity`` of the local education autonomy law comparing with the cases of the constitutional court. And reviewed the actual effectiveness through the results of direct superintendent election by residence in 2010. As a conclusion, there is a gab between the ``norm validity`` and ``actual effectiveness``. The future development is dependent upon the people`s consciousness of the right and participation in the local education autonomy, and the instruction of social efficiency is more important than economical efficiency
