헌법원리에 비추어 본 교육감 직선제의 문제점과 제(諸)대안의 적실성 검토

국문 초록

직선제에 기반하고 있는 현행 교육감 선출제도는 헌법상 지방자치의 주요 원리인 주민대표성을 실현한다는 점에서 장점을 지니고 있으나 지역주민의 인지도 부족으로 인한 무관심 선거, 과도한 선거비용에 따른 비리 발생, 지자체장과의 이념대립으로 인한 갈등, 교육전문성 검증의 미약, 정당 및 교원단체의 정치적 영향으로 인하여 여전히 교육의 정치적 중립성이 훼손되는 등 여러 문제점을 안고 있는 것으로 지적되고 있다. 이러한 교육감 선출제도의 개선에 대해서는 크게 직선제 개선론과 대안 모색론으로 논의되어 왔다. 그런데 현행의 교육감 직선제를 유지하자는 주장이나 대안을 도입하자는 주장에 동원되는 헌법원리와 근거논리 유사하다는 사실은 현행 교육감 직선제의 주요 대안으로 거론되고 있는 시·도지사 임명제, 제한적 직선제, 러닝메이트제, 공동등록형 주민 직선제 중 어느 하나도 수용불가능 할 만큼 우리 헌법상의 지방자치 및 교육자치의 기본원리에 어긋나지는 않는다는 것을 의미한다. 그렇다면 교육감 선출제도의 대안에 대한 적실성 판단에는 민주주의나 교육의 자주성·전문성·정치적 중립성과 같은 헌법 원리 뿐 아니라 그에 못지않게 교육감 직선제의 부작용과 문제점 해소에 적합한 제도적 장점이 있느냐 하는 기준을 중요한 판단요소로 삼을 수 있을 것이다. 이러한 관점에서 볼 때 우선 공동등록형 주민직선제가 비교적 많은 제도적 장점을 가지고 있어 현행 주민직선제가 야기하는 여러 가지 문제점을 해결할 수 있는 단기적인 대안이 될 수 있을 것으로 보인다. 그러나 장기적으로는 러닝메이트제로 이행하는 것이 바람직한 것으로 판단된다.

영문 초록

The current electoral system of superintendent of education based on the direct election system has merits of realizing the constitutional principles of local autonomy system of representative nature of local residents. However, it has also many defects such as extreme election apathy, corruption implicating excessive campaign expenses, ideological confrontation between the local government heads and the superintendents of school, the damage of political impartiality due to political parties, teachers groups, etc. Such being the case, many improvement plans and alternatives have been discussed in recent years. Alternatives mentioned for the direct election of superintendent of education are the system of appointment by the local government heads, restrictive direct election system, running mate system, direct election system with co-registration, etc. By the way, the fact that constitutional principles and grounds of logic of the respective alternatives are similar means that any of the alternatives could be compatible not only with the constitutional principles of independence, professionalism and political impartiality of education, but also with side effects and solution of problems of the direct election system. If it is so, what the best alternative to the direct election of superintendent of education is judged by the efficacy and workability of the alternatives. In this respect, the direct election system with co-registration has reason enough to choose owing to its many strong points for the time being, however, we need to change our electoral system to running mate system in the long run.
