아동학대범죄에 대한 선교신학적인 실천방안에 관한 연구

국문 초록

본 연구의 목적은 최근까지 이슈화되고 있는 아동학대범죄에 대한 실태를 분석하고, 아동복지 내지 아동보호에 관해서 살펴보고, 최근에 만들어진 특별법 등을 법적으로 검토할 뿐만 아니라 앞으로의 선교신학적인 방향성을 살펴보는 데 있다. 아동복지법에 의한 아동학대 라 함은 보호자를 포함한 성인에 의하여 아동의 건강·복지를 해치거나 정상적 발달을 저해할 수 있는 신체적·정신적·성적 폭력 또는 가혹행 위 및 아동의 보호자에 의하여 이루어지는 유기와 방임을 말한다. 아동학대범죄의 원인론적 관점에는 정신병리학적 관점, 발달론적 관점, 사회문화적 관점, 생태학적 관점 등이 있다. 아동학대 전문기관의 자료에 따르면, 현재 먼저 학대행위자 유형 별로 친부모로부터 가장 높은 비율을, 다음으로 행위유형별로 볼 때 중복학대가 가장 높은 비율을, 마지막으로 성별로 볼 때에는 여자가, 연령으로 볼 때에는 만 12~14세가 가장 높은 비율을 차지하고 있다. 우리나라의 아동학대 및 방임아동을 위한 관련법으로는 형법, 아동복지법, 가정폭력방지 및 피해자보호 등에 관한 법률, 성폭력범죄의 처벌 및 피해자 보호 등에 관한 법률 등을 들 수 있다. 그리고 2015년 10월 현재 아동보호전문기관은 전국에 54개소가 설치·운영 중에 있다. 우리나라의 아동보호 서비스과정은 크게 볼 때 신고접수, 초기 사정·조사, 서비스의 계획, 서비스의 제공, 진척상황의 평가, 사례종 결의 6단계로 살펴볼 수 있다. 오늘날 이에 대한 기독교 아동복지 실천방안이 아직도 진행 중에 있다고 할지라도 예수 그리스도의 사랑의 정신을 본받아 전문성과 사회봉사에 대한 선교신학적인 검토와 실천이 요구된다.

영문 초록

This study reviewed current status of child abuse reported to the agencies for types of child abuse, locations where child abuse was occurred, current status of the services for child abuse cases in relation to the Missiological Countermeasure of Child Abuse Crime. To do this, a literature survey for the materials related to child abuse was conducted, including journals, statistics, book etc. As one of the critical issues, The term ‘child abuse’ is considered as the physical, sexual or emotional maltreatment or neglect of a child or children. Although the current korean legal systems related to child abuse are scattered across several laws and regulations, it is deemed necessary to revise the child welfare law and the child abuse special law in order to protect the child’s human rights effectively because the current laws shows the incomplete shape or indefinite aspects. And child protective services consists of six process including intake, initial assessment & investigation, service planning, service provision, evaluation of progress, and case termination. When we see the new model of child welfare, it is focused on holistic human which is responsible for child welfare to the spiritual well-being in view point of Christianity. The primary goal of the Christian life is oriented according to the Kingdom of Heaven. The Bible also realize the spirit of Jesus Christ’s love. In other words, by promoting the growth and development of most children on the basis of God’s children the effective child welfare service should be aimed to bring abundant life. The Child welfare act in Korea shows construction of child abuse and neglect with the type of classification. Several ministry work related to child abuse can be responded be preaching or community seminars and so on. In future, Concerning social mission and social service in church and community, it will be effectively dealt with the expertise and special programs of child welfare in order to treat with the practical issue of child abuse within Jesus Christ.
