배상명령제도의 실무상 문제점과 그 개선 방안

국문 초록

범죄피해자의 신속한 권리구제를 위해 마련된 배상명령제도는 그 제도적 의의에도 불구하고 실무상 이용률은 높지 않은 실정이다. 본고에서는 실무적 관점에서 배상명령제도의 활성화를 저해하는 몇 가지 문제점을 살펴보고 이를 개선하기 위한 방안, 즉 대상범죄의 확대, 일부 인용의 활성화, 지연손해금에 대한 배상명령, 민사소송절차와의 연계, 법률조력인의 관여 확대, 신속한 배상신청 유도, 조기 배상신청 각하, 직권 배상명령, 안내문 교부와 철저한 정본 송달, 배상명령의 실효성 확보 방안 등을 검토하였다.

영문 초록

Notwithstanding the system significance, the restitution system for the rapid relief of a crime victim’s right has not been much utilized at the practical level. This study got an overview of several issues that hinder the activation of the restitution system from the practical point of view and recommended various methods in order to improve the situation. First, the scope of the crimes subject to the restitution system should be expanded, and the partial recognition of the system among the accusation cases should be activated. Second, the rapid restitution application should be encouraged and if the restitution application is not based upon proper grounds, it should be dismissed and if necessary, the restitution order should be imposed by authority. Third, the restitution order should be linked with the civil cases and the legal support to the crime victims should be actively provided. Fourth, the methods for the effectiveness of the restitution system should be sought out and the guidelines, and if the restitution order is rendered, the final decision order should be published in a strict manner.
