국가 교육과정과 교육법규의 관련성 분석

국문 초록

본 연구는, 2009 개정 교육과정 고시와 관련하여 2009 개정 교육과정 총론이 교육과정 관련 교육 법규의 규정을 충분히 반영하고 있는지의 여부와 더불어 교육과정 관련 교육법규가 교육과정의 구성 영역별로 국가 교육과정을 구현하기 위한 교육법규의 윤리적․규범적 성격, 수단적·기술적 성격, 조장적·지원적 성격을 갖추고 있는지 검토함으로서 국가 교육과정의 정당성을 확보하고 그 구현방안을 모색하고자 하였다. 연구결과, 2009 개정 교육과정 총론에서는 학교 급별 교육목표, 학습윤리의 확립에 관한 내용, 부진아 교육에 대한 규정 등이 교육법규의 규정을 충분히 반영하지 못하였으며, 교육과정 관련 교육법규에서는 학교의 교육과정 편성권과 국가 교육과정의 개정과 관련하여 변화된 교육내용 및 교육방법을 교육현장에 구현하기 위한 직접적인 규정 등이 미흡하고, 초·중등학교의 교과를 전반적으로 규정하고 있는 교육법규와 특정 교과 및 교육내용을 규정하고 있는 교육법규가 교육과정의 측면에서 충돌될 여지가 있다는 점 등이 발견되었다. 앞으로 교육법규가 학교교육의 교육과정을 통하여 구현되기 위해서는, 현재의 국가 교육과정이 교육법규를 잘 반영하고 있는지 분석하고, 국가 교육과정의 구현을 위한 바람직한 교육법규의 규정 방안과 더불어 교육법규의 규정을 국가 교육과정으로 구현해내기 위한 구체적인 방법이 모색되어야 할 것이다.

영문 초록

The aim of this study is to secure the legitimacy and to seek the legal realization of 2009 National Curriculum. To fulfill this, this study reorganizes the educational laws and regulations according to the component areas of curriculum, and examines the roles of the educational laws and regulations according to the general guideline of national curriculum and the traits of the educational laws and regulations. As a result, 2009 National Curriculum does not reflect the educational laws and regulations in the educational objectives of school levels, moral principles in learning, the regulations about the retarded, and so on. And the educational laws and regulations do not regulate the right of school's role in curricular decision, and it is possible to come into confliction among the subject matters' interest in the educational laws and regulations. To make adequate connections between them, I suggest the follow-up research which is to analyze the educational laws and regulations in the light of curriculum, to make the desirable ways to revise them, and to make the appropriate methods to realize the educational laws and regulations into the curriculum.
