AI 시대 법률가 역량 강화에 관한 시론적 연구

국문 초록

본 연구에서는 헌법 제10조가 명시한 인간의 존엄과 가치를 비롯한 기본권을 보호라는 중대한 역할을 하는 법률가의 역량에 대해, 그 중요성과 구성요소, 역량교육의 현황, AI 시대의 법률가 역량 과제 등에 대한 논의를 시도하였다. 제Ⅰ장에서는 법률가 역량, 특히 AI 시대에 요구되는 법률가의 역량에 대한 연구의 중요성과 의의를 논의하였고, 제Ⅱ장에서는 법률가 역량의 의미와 지표에 대한 논의로 법률가의 개념, 법률가 역량의 개념, 법률가 역량지표의 중요 요소, 법률가로서 가져야 할 덕목, 소양, 능력 등에 대하여 고찰하였다. 제Ⅲ장에서는 현행 법률가 양성제도와 법률가 역량교육의 현황을 분석하였다. 제Ⅳ장에서는 법률가 역량 강화 제도에 대하여 검토하며, 1. 법조인 양성을 위한 법학교육에서의 강화, 2. 변호사시험 개선, 3. 신분보장을 통한 역량강화와 공정한 재판 역량 확보를 위한 제도 모색, 4. 지속가능한 역량 강화 방안을 탐색하였다. 제Ⅴ장에서는 사회 전반에 급속히 확산되는 AI 기술 도입과 새로운 패러다임 등장에 기반하여 AI 기술 시대의 법률가 역량을 전망하고, 향후 수행해야 할 과제들을 제시하였다. 본 연구에서 시론적으로 검토한 연구과제들에 대해, 분야별·직역별 심층 분석과 구체적인 발전 방안에 대한 후속 연구가 활발히 전개되어, 이를 통해 보다 향상된 법률가 역량이 구축되고, 인간에 대한 법률가의 보호 역할 또한 더욱 강화되기를 기대한다.

영문 초록

This study examines the competencies of legal professionals in relation to the fundamental rights, including human dignity and values explicitly articulated in Article 10 of the Constitution, focusing on their vital role in protecting these rights. The discussion encompasses the significance and constituent elements of these competencies, the current state of competency education, and the challenges faced by legal professionals in the AI era. Chapter I discusses the importance and significance of research on legal competency, particularly in the context of the AI age. Chapter II explores the meaning and indicators of legal competency, considering concepts such as the definition of legal professionals, the notion of legal competence, key elements of competency indicators, and the virtues, literacy, and abilities that lawyers should possess. Chapter III provides an analysis of the current legal education system and the state of competency development programs for legal practitioners. In Chapter IV, the focus is placed on reviewing the institutional mechanisms for strengthening legal competencies, including: (1) enhancing legal education to foster legal professionals, (2) improving the bar examination system, (3) Strengthening competencies through the reinforcement of employment security and exploring systems to ensure the capability for fair trials, and (4) exploring sustainable measures for ongoing competency development. Chapter V projects future outlooks for legal competencies amid the rapidly spreading paradigm shift driven by AI technologies across society and proposes directions for future tasks. It is hoped that subsequent research will expand on the research topics preliminarily examined in this study through in-depth, field-specific analyses, and the development of practical strategies. Ultimately, such efforts are expected to enhance the capabilities of legal professionals and to further strengthen their role in protecting human rights.
