국문 초록

본 연구는 길버트와 테렐의 사회복지 정책 분석틀을 활용하여 「북한이탈주민 보호 및 정착지원에 관한 법률」(이하 북한이탈주민법)을 분석하고, 이에 대한 개선 방안을 제안하는 것을 목표로 한다. 북한이탈주민의 안정적 정착과 사회통합은 대한민국의 중요한 정책 과제 중 하나이며, 북한이탈주민법은 이를 위한 제도적 기반을 제공하고있다. 그러나 현행 법률은 변화된 환경과 북한이탈주민의 욕구를 충분히 반영하지 못함에 따라 복지 사각지대와 제도적 한계가 지속적으로 발생하고 있다. 연구 결과, 첫째, 지원 대상의 정의가 모호하고, 거주지 보호 기간이 제한적으로 설정되어 있어 북한이탈주민이 복지 사각지대에 놓일 위험이 존재함을 확인하였다. 둘째, 법률의 목적과 지원 내용이 초기 정착지원에 집중되어 있어, 사회통합을 고려한 포괄적 지원 체계 마련에 한계가 있음을 확인하였다. 셋째, 정착지원 전달체계가 중앙정부 중심으로 운영되어 지방자치단체의 역할이 제한되고, 이에 따라 지역 간 서비스 격차가 심화되고 있음을 알 수 있었다. 마지막으로, 정착지원 서비스가 전적으로 국고보조사업에 의존함으로써, 지방자치단체의 낮은 재정자립도가 지속 가능한 지원 체계 구축의 장애요인으로 작용하고 있음을 확인하였다. 이에 대한 개선방안으로 북한이탈주민법의 목적을 사회통합적 중심으로 재정립하고, 복지 사각지대 해소를 위해 지원 대상을 명확히 규정하며, 지원 체계를 개선할 것을 제안하였다. 또한, 거주지 보호 제도를 정비하여 포괄적 정착지원 체계로 전환하고, 지방자치단체의 역할을 강화하여 지역 중심의 전달체계를 확립할 필요성을 강조하였다. 본 연구는 북한이탈주민법을 사회복지적 관점에서 체계적으로 분석하고 북한이탈주민의 안정적 정착과 사회통합을 위한 실질적이고 지속 가능한 법적 기반 마련을 위한 개선방안을 제시했다는 점에서 학문적 의의를 가진다.

영문 초록

This study aims to analyze the 「North Korean Defectors Protection and Settlement Support Act」 using Gilbert and Terrell's social welfare policy analysis framework and to propose improvements. The stabilization and social integration of North Korean defectors is one of South Korea's key policy agendas, and the North Korean Defectors Act provides the institutional framework for their protection and settlement support. However, the current law fails to fully reflect the changing environment and evolving needs of North Korean defectors, resulting in persistent welfare blind spots and institutional limitations.The results of the analysis are as follows. First, the definition of support beneficiaries under the law is ambiguous, and the limited duration of residence protection increases the risk of social marginalization. Second, the purpose and support programs of the law focus mainly on initial settlement assistance, which limits the ability to establish a comprehensive support system that considers long-term settlement support and social integration. Third, the settlement support delivery system is operated mainly by the central government, thereby restricting the role of local governments and exacerbating regional disparities in services. Lastly, the support services' dependence on central government funding, due to the low financial autonomy of local governments, acts as a barrier to building a sustainable support system. Based on these findings, this study proposes to redefine the purpose of the North Korean Defectors Act with a focus on social integration, clarify the definition of beneficiaries to eliminate welfare blind spots, and improve the overall support system. Additionally, it emphasizes the need to reform the residential protection system into a comprehensive settlement support system and to strengthen the role of local governments in establishing a region-centered delivery system. This study systematically analyzes the North Korean Defectors Act from a social welfare perspective and proposes practical, sustainable legal reforms to facilitate the stable settlement and social integration of North Korean defectors.
