민주주의 후퇴국에서의 포퓰리즘적 사법개혁: 이스라엘과 멕시코의 사례연구

국문 초록

본 논문은 민주주의 후퇴가 나타나는 국가들에서 통치자에 의한 사법개혁이 갖는 포퓰리즘적 요소들을 살펴본다. “부패한 엘리트에 대한 반감”과 “인민의 다수의지의 강조”를 포퓰리즘의 특징이라 할 때, 사법부는 포퓰리즘의 관점에서 비판과 개혁의 대상이 될 수 있다. 선출되지 않은 소수의 엘리트로 구성된 사법부는 의사결정 과정 및 그 결과에 있어 국민 다수의 뜻과 유리되기 쉬우며, 사법심사를 통해 국민이 선출한 대통령과 의회의 결정을 무효화시킬 수 있는 권한을 갖고 있기 때문이다. 본 논문은 포퓰리즘적 사법개혁의 특징으로 사법부의 엘리트 중심성과 부패에 대한 비판, 비선출기관(사법부)에 대한 선출기관(행정부, 입법부)의 우위 강조, 사법임명 과정에서 국민의 직접적･대의적 선출의 비중 확대를 제시한다. 이와 함께 최근 논쟁적인 사법개혁을 단행한 이스라엘과 멕시코의 사례를 분석하여, 통치자의 이념 성향 및 사법개혁의 구체적인 내용에서의 차이에도 불구하고 두 국가의 사법개혁에서 포퓰리즘적 요소가 공통적으로 나타났음을 밝힌다. 아울러 이러한 사법개혁은 사법독립의 약화, 권력분립 및 견제와 균형의 붕괴를 통해 민주주의 후퇴를 더욱 가속화시킴을 주장한다.

영문 초록

This article examines the populist features of judicial reform in countries experiencing democratic backsliding. When defining “antipathy toward corrupt elites” and “emphasis on the will of the people” as key aspects of populism, the judiciary can be seen as a target for criticism and reform by populists. This is because the judiciary, composed of a small, unelected elite, often appears disconnected from the majority’s will in its decision-making and outcomes, and it exercises judicial review to invalidate the decisions of the elected officials. This article identifies three characteristics of populist judicial reform: (a) criticism of the judiciary’s elite-centered nature and corruption, (b) prioritizing the authority of elected bodies (the executive and legislature) over unelected institutions (the judiciary), and (c) judicial appointments that better reflect the will of the people. It also analyzes recent judicial reform cases in Israel and Mexico, demonstrating that populist elements are prevalent in both countries, despite differences in rulers’ ideological orientations and specific reform details. Finally, this article suggests that populist judicial reform may accelerate democratic backsliding by weakening judicial independence and undermining the separation of powers along with checks and balances.
