범죄피해 아동의 법률 문해력: 법률용어와 전문가 역할 이해도를 중심으로

국문 초록

본 연구는 범죄피해 경험 아동을 대상으로 주요 법률용어와 법률전문가에 대한 인지도 및 이해도를 분석했다. 해바라기센터에서 초기 진술을 한 아동 총 50명(여아 34명, 남아 16명)을 대상으로 12개의 주요 법률용어에 대한 인지도, 이해도, 법률전문가 역할 이해도를 측정하였다. 연구결과 ‘경찰’, ‘감옥’ 등의 용어는 높은 인지도를 보였으나, ‘기소’, ‘검사’와 같은 용어의 의미나 법적 역할에 대한 이해도는 전반적으로 낮았다. 한편 10세 이상일수록, 반복피해 경험이 존재할수록 ‘변호사’의 역할에 대한 이해도가 통계적으로 유의미하게 높았다. 용어 인지도, 용어 이해도, 역할 이해도 세 요소를 종합한 지수를 만들어 분석한 결과 가장 중요한 설명 변수는 연령인 것으로 나타났다. 연구결과, 아동의 연령 및 피해 경험 유형에 따라 법률용어 이해 정도에 차이가 존재함을 알 수 있었다. 이를 바탕으로, 개별 아동의 인지 수준과 연령에 맞는 차별화된 사법 지원이 이루어져야함을 제안하였다.

영문 초록

This study analyzed the level of awareness of major legal terms and understanding of legal professionals among child victims of crime. A total of 50 children (34 girls, 16 boys) who gave initial statements at Sunflower Centers were surveyed to measure their recognition, understanding, and comprehension of legal professional roles regarding 12 major legal terms. The results showed that terms such as ‘police’ and ‘prison’ had high recognition rates, but overall understanding of the meaning and legal roles of terms such as ‘prosecution’ and ‘prosecutor’ was low. Meanwhile, children aged 10 or older and those with repeated victimization experiences showed a statistically significant higher level of understanding of the role of a lawyer. Analysis of a composite index combining recognition, understanding, and comprehension of legal professionals showed that age was the most important explanatory variable. The study found that differences exist in the degree of legal term understanding according to children’s age and type of victimization experience. Based on these findings, the study proposed that differentiated judicial support tailored to individual children’s cognitive levels and ages should be provided.
