국문 초록

논문은 가상공간을 독립된 법적 영역으로 정립할 가능성을 고찰하는 데 목적이 있다. 가상공간은 현대 사회에서 하나의 생활공간으로 자리매김하였으며, 기존의 물리적 공간을 전제로 형성된 법체계에 새로운 화두를 던지고 있다. 본 연구에서는 마셜 맥루언(Marshall McLuhan)의 “미디어는 그 자체로 메시지다”라는 명제를 출발점으로 삼아, 가상공간의 매체적 특성과 현실로부터의 자율성을 규명하고자 한다. 이를 위하여 법학에서의 공간 개념, 인공지능 법인격 논의와의 비교, 가상공간에서 발생한 법적 사례들(메타버스 내 범죄, 게임 아이템의 재산성, 온라인 커뮤니티의 표현규제 등)을 분석한다. 이러한 분석을 통해 가상공간이 단순히 법적 행위가 이루어지는 장소에 그치지 않고, 일정한 자율성과 규범 체계를 갖춘 법적 무대로 기능할 수 있음을 살펴본다. 결론적으로 본 논문은 가상공간에 적용될 수 있는 새로운 법적 체계의 필요성을 제기하며, 현실 법질서와의 조화될 수 있는 법리 구성을 제안한다.

영문 초록

This paper aims to examine the possibility of establishing virtual space as an independent legal domain. Virtual space has established itself as part of everyday life in modern society, posing new challenges to the existing legal system that was predicated on physical space. The study takes Marshall McLuhan’s adage “the medium is the message” as a starting point to elucidate the characteristics of virtual space as a medium and its autonomy from reality. To this end, it analyzes the concept of space in legal scholarship, compares it with the discourse on the legal personhood of artificial intelligence, and examines legal cases arising in virtual space (such as crimes in the metaverse, the property status of game items, and the regulation of expression in online communities). Through this analysis, the paper demonstrates that virtual space is not merely a venue for legal acts but can function as a legal arena endowed with a certain degree of autonomy and its own normative order. In conclusion, the paper highlights the need for a new legal framework applicable to virtual space and proposes a jurisprudential approach that can be harmonized with the existing legal order in the real world.
