국문 초록

이 연구는 공공기관 인권경영의 한계로 작용하는 근본적인 요인을 분석하여 합리적인 규제 전략을 수립하는 것을 목적으로 하며, 연구 목적을 수행하기 위해 신행정법학의 방법론으로 논의되는 제어국가의 이론적 틀을 사용하였다. 국내 인권경영 규제 체계는 경영실적평가제도를 통해 공공기관에 인권경영을 도입한 이후 민간부문으로 확산하는 방향으로 설계되었다. 따라서 인권경영이 민간부문에 영향력을 미치기 위해서는 공공기관의 성과가 중요하다. 그러나 공공기관의 인권경영은 도입 이후 형식적인 절차에 머무르고 있으며, 이것은 공공기관의 특성상 근원적인 한계로 이해되기도 한다. 인권실사의 법제화가 방안으로 제시되고 있으나, 제어이론의 관점에서 법을 매개로 하는 국가의 제어능력의 한계와 가능성을 정밀하게 분석할 필요가 있다. 이 연구는 인권경영 규제 체계와 공공기관의 인권경영 현황을 분석하여 합리적인 규제 전략을 수립하였다. 국가인권정책기본계획과 국가를 당사자로 하는 계약에 관한 법률, 경영실적평가제도, 국가인권위원회의 보고 및 평가 지침의 개선을 통해 공공기관의 인권경영 규제 체계를 강화할 수 있는 방안을 제시하였다.

영문 초록

This study aims to establish a rational regulatory strategy by analysing the fundamental factors that act as limitations to ‘Business and Human Rights’ in public institutions. To achieve this goal, the study uses the theoretical framework of the steering state, which is discussed in the methodology of administrative law. The domestic ‘Business and Human Rights’ regulatory system was designed to spread to the private sector after the introduction of ‘Business and Human Rights’ to public institutions through the ‘Evaluation of Management Performance’ system. Therefore, the performance of public institutions is important for ‘Business and Human Rights’ to have an impact on the private sector. However, ‘Business and Human Rights’ of public institutions has remained in a formal process since its introduction, which is sometimes understood as a fundamental limitation due to the nature of public institutions. Legalisation of human rights due diligence is being proposed as a solution, but it is necessary to analyse in detail the limitations and possibilities of the state's steering ability through the law from the perspective of steering theory. This study analyzed ‘Business and Human Rights’ regulatory system and the current state of ‘Business and Human Rights’ in public institutions to establish a reasonable regulatory strategy. It proposed ways to strengthen the regulatory system for ‘Business and Human Rights’ in public institutions by improving the National Human Rights Plans of Action, the Act on Contracts to Which the State is a Party, the Evaluation of Management Performance system, and the Business and Human Rights Reporting Directive of the National Human Rights Commission.
