국문 초록

본 연구에서는 유치권의 주요한 쟁점을 요인변수로 하고 계층요인은 도출하여 이슈요인과 AHP기법을 활용한 분석을 통해 중요도의 인식과 우선순위를 도출하였다. 유치권 성립요인은 대변수로, 하위변수인 계층요인은 이슈와 쟁점이 많았던 판례를 변수로 도출했다. 유치권의 목적물에서는 주거용, 상업용 및 기타 특수용, 용도복합용, 기타는 대한민국법원경매 사이트의 용도 분류를 근거로 하였다. 견련성의 변수는 임차권, 소유권이전등기 청구권의 이행불능, 소유권에 의한 목적물 반환청구권, 양도담보 계약해지, 손해배상청구권을 문헌고찰과 판례, 학계논문을 근거로 도출하였다. 변제기 변수는 공사대금채권, 기한부채권채무, 소멸시효, 자동채권과 수동채권을 문헌고찰과 판례, 학계논문 을, 변제받지 못한 채권변수는 미신고된 회생채권, 채권자 변제받기 거부, 채무부존재확인, 별제권, 채권양도를 문헌고찰 및 대법원 판례, 학계의 자료를 인용했다. 점유의 적법성변수는 점유상실, 선관주의 의무, 점유강탈, 간접점유, 업무방해죄를 문헌고찰 및 대법원 판례의 자료를 인용했다. 타인소유변수는 자기점유, 재물손괴죄, 횡령죄, 공소시효, 권리전부를. 특약변수는 유치권포기각서, 조건의 항변, 채권자보호법, 민･상사유치권, 불공정계약 자료를 인용했다. 분석결과, 요인변수와 계층변수의 이슈와 중요도 인식, 우선순위를 확인할 수 있었다. 유치권의 이슈와 중요도에 대한 실증분석을 경매전문가나 일반인에게 실시하여 전문가와 일반인의 유치권의 인식과 중요도의 차이를 제시함으로 인하여 유치권 경매에서 일반인의 전문지식의 함양의 필요성과 유치권의 개선방향성을 찾고자 하였다.

영문 초록

In this study, the main issue of lien was set as a factor variable and the hierarchical factors were derived, and major issue factors, importance awareness and priority were derived through the analysis using the AHP technique. In the hierarchical factors, specific precedents of lien variables were cited, and residential, commercial and other special use, mixed use, and others were based on the use classification of the Korean court auction site, Variables of consistency were derived based on literature review, precedents, and academic papers on the right to lease, the inability to fulfill the right to claim transfer of ownership, the right to claim the return of the object by ownership, the termination of the transfer security contract, and the right to claim damages.,The variables of the repayment period are the construction price bond, the due date bond debt, the statute of limitations, the automatic bond and the manual bond, the literature review, the precedent, the academic paper, and the unregistered bond variable is the unrecognized revolving bond, the refusal to be reimbursed by the creditor, the confirmation of the absence of the debt, , And the transfer of the bonds to the literature review, Supreme Court precedents, and academic data.,The legality variables of occupancy are the loss of occupancy, obligation of preemption, occupancy, indirect occupancy, obstruction of business, and the data of the Supreme Court precedents.,The special variables cited lien abandonment memorandum, conditional plea, creditor protection law, civil and commercial lien, and unfair contract data. As a result of the analysis, it was confirmed that the issue of the factor variable and the importance and priority of the lien of the hierarchical variable were recognized.,The fact that this study attempted to empirically analyze the major issues and importance of lien can be said to have great implications for general theory or practical learning of lien auction to auction experts or the general public.
