국문 초록

본 논문은 부동산 경매 과정에서 빈번히 발생하는 위법행위 중 형사법적 판단이 요구되는 쟁점을 중심으로, 이들 행위가 단순한 사적 권리분쟁을 넘어 공적 법익을 침해하는 범죄로 평가될 수 있는지를 법리적･실무적으로 분석한다. 특히 외형상 ‘정당한 권리행사’로 포장된 권리남용 행위를 입찰방해죄, 사기죄, 공갈죄 등의 구성요건과 비교하여 그 적용 가능성과 한계를 비판적으로 고찰하였다. 아울러 수사기관의 대응 과정에서 나타나는 피해자 개념의 불명확성, 공범 구조의 입증 곤란, 경매 실무기관과 수사기관 간의 단절 등 제도적 문제를 구체적으로 지적하였다. 또한 독일, 미국, 일본의 형사입법례와 제도 운영 방식을 비교분석함으로써, 국내 법제도 개선의 방향성과 실효성 있는 해석기준 마련의 필요성을 강조하였다. 이를 통해 본 논문은 부동산 경매 절차에서의 구조적 취약성과 권리남용의 형사책임 가능성을 종합적으로 규명하고, 향후 수사제도･입법정책･법문화 전반에 대한 통합적 개혁의 방향을 제시하고자 한다.

영문 초록

This study examines key criminal law issues arising in real estate auction procedures, focusing on acts that appear to involve legitimate exercise of rights but in essence constitute abuse of rights and disrupt public legal order. The paper critically analyzes the applicability and limitations of criminal offenses such as bid-rigging, fraud, and extortion within the auction context. It also identifies structural problems in investigative and judicial practices, including the ambiguous concept of “victim,” difficulties in proving complicity, and insufficient cooperation between courts and investigative agencies. Through a comparative analysis of relevant legislation and practices in Germany, the United States, and Japan, this paper provides legal and institutional insights for improving Korea’s criminal justice response. Ultimately, the study seeks to reestablish the protective function of criminal law in the real estate auction market and proposes an integrated reform agenda combining legal interpretation, institutional coordination, and future-oriented policy design.
