국문 초록

이 논문은 현재 이슈화 되고 있는 비트코인과 관련한 범죄들에 대한 사례분석과 대응방안을 마련하는데 연구의 목적이 있다. 매일 비트코인 등을 필두로 한 가상화폐관련 뉴스들과 연구자료들이 쏟아져 나오고 있지만 정부나 국가기관에서는 방관의 자세를 유지하고 있다. 이미 다른 선진국들은 가상화폐에 대한 규제를 통해 국가에서 직접 관리하게끔 만들어 운용하고 있지만 아직 우리나라는 관련 논의조차 안되는 실정이다. 가상화폐와 관련된 범죄들은 끊임없이 발생하는 추세에 있고 특히 비트코인이 가지고 있는 특성들이 범죄에 사용되기 좋은 요건이 되고 있다. 이에 본 연구는 비트코인과 관련된 범죄사례를 분석하고, 세계 여러나라의 법적 규제를 통해 우리나라에 맞는 제도적 장치를 마련하는 것에 초점을 두었다. 이를 위해서 2장에서는 비트코인에 대한 개념과 그 특성에 대해 설명하였다. 3장에서는 현재 발생하고 있는 비트코인과 관련한 범죄들에 대한 사례분석을 하였으며 4장에서는 해외 각국에서 실시하고 있는 규제에 대해 설명하였다. 5장에서는 2장에서 분석한 범죄사례에 대한 대응방안을 제시하였다. 본 논문은 비트코인관련 범죄에 대한 대응방안으로서 4가지의 방안을 제시하였는데, 첫째는 비트코인과 관련하여 범죄피해를 당한 사람들에 대한 법적 장치를 마련하는 것이다. 가상화폐에 대한 정의와 비트코인 손실에 따른 피해보상을 위한 법적 보호장치를 마련하여 피해자들의 피해를 최소화해야 할 것이다. 둘째, 비트코인 거래소의 허가기준을 설정하는 것이다. 현재 비트코인 거래소는 몇 가지의 신고요건만 갖추면 누구나 설립할 수 있기 때문에 해킹 등의 위험에 취약하다. 그렇기 때문에 일정한 보안요건을 갖추는 것을 의무화시켜 해킹 등의 위험으로부터 보호해야한다. 세째 거래소의 자금세탁 방지 및 테러자금 제공에 대한 규제 신설이다. 비트코인은 익명성 때문에 해외에서 자금세탁에 빈번하게 사용되고 있다. 그렇기 때문에 법정통화로 환전할 시 현금지급이 아닌 계좌 입금을 원칙으로 하며 계좌는 국내은행 계좌로만 하게 해야 한다. 또한 거래소는 자금세탁 및 테러자금 제공에 대해서 의심이 가는 거래내역은 의무적으로 보고서를 작성 및 보관을 하여야 한다. 네번째는 금융감독원에 가상화폐 전담팀을 신설하여 비트코인의 환전에 관련 업무를 전담하고 자금세탁이나 불법자금 유통 등에 대해 지속적인 모니터링을 하게 해야 한다. 비트코인의 활용은 초기단계이며 앞으로 무궁무진한 발전단계를 보여줄 것이다. 또한 그만큼 비트코인과 관련하여 신종 범죄들도 많이 발생할 것이다. 그렇기 때문에 우리는 지속적으로 발전상황을 봐야 하며 체계적인 관리를 통해서 발생할 수 있는 문제들을 손쉽게 대처해야 한다.

영문 초록

The study is aim to discuss how to the case analysis of the Bitcoin-related crime and it’s countermeasures. News and research materials with the virtual currency published at the every day. But government and national organizations looked on with folded arms. Already any other developed country supervised the bitcoin by the virtual currency-related regulation. But Republic of Korea did not debate the regulation. On the other hand, Virtual currency-related crime with bitcoin-related crime constantly occurred in the community. Especially, Bitcoin-related crime are frequent by the bitcoin quality. So we explained the definition and properties of the Bitcoin. Also we analysed the Bitcoin-related crime and we explained the legal regulation in the various countries. Further, We suggested the countermeasures. Therefore we provided four solutions on how to countermeasure of the Bitcoin-related crime. First, we should enact a legal protection that minimized the damage from the Bitcoin-related crime. Secondly, we should make a license standard on the Bitcoin exchange. Recently, The general public established a Bitcoin exchange when fulfilled the requirements. Therefore Bitcoin exchange was vulnerable to the perils of hacking, etc. So we need a license standard. Thirdly, we should enact a law of the Anti-Money Laundering and Combating the Financing of Terrorism on the Bitcoin exchange. The Bitcoin used a frequent Money Laundering by reason of anonymity. Therefore we should enact a law. People only must use a yours account in the domestic bank when exchanged legal tender at the Bitcoin. Also Bitcoin exchange must make a report of the transactional information that began to doubt of the Anti-Money Laundering and Combating the Financing of Terrorism and they must keep the report too. Finally, we should make a department of the virtual currency in the Financial Supervisory Service. The bitcoin utilization is still in the early stages. However it will show a infinite stage of development in the future. Also many a new bitcoin-related crime will occur in the community. Thus, We shall consistently look at the developments and we have easily handle the problem through the methodical supervision
