지방자치권한 및 지방분권 확대에 따른 지방자치단체장의 책임성 강화 방안

국문 초록

우리나라는 30여년 동안 지방자치를 실시하여 오면서 지방자치단체의 책임성의 문제를 자치권강화와 지방분권 강화의 주안점에서 논의되어 왔다. 저출산·고령화와 지역인구감소로 지역소멸위기가 대두되고 있다. 지방자차단체장의 권한확대와 자치분권이 강화된 지방자치행정의 환경변화에 따른 책임성을 확보할 수 있는 제도적인 장치마련이 시급하다고 할 것이다. 지방자치단체장의 청렴성과 도덕성이 담보되지 않고서는 지방자치단체의 역량과 경쟁력을 확보할 수 없다고 할 것이다. 지방자치단체의 자치권과 지방분권의 성과를 김대중 정부 때부터 윤석열 정부까지 성과를 분석한 후, 지방자치환경변화에 따른 지방자치단체장의 책임성 강화의 필요성을 검토한다. 지방자치권강화에 따른 지방자치단체장의 인사권이 확대된 만큼 지방자치단체장의 인사고권에 대한 책임성을 강화하기 위하여 지방자치단체장과 독립된 인사위원회의 설치문제를 논의한다. 또한 광역지방자치단체장의 경우 기초지방단체장이나 지방의회의 의원 경험을 거쳐 광역지방자치단체장으로 진출하기 보다는 국회의원으로서 의정경험과 중앙정부의 장관 등의 행정경험이 풍부한 사람이 당선되고 있는 것이 대부분이고, 초선으로 당선된 지방자치단체장은 주민의 의견을 청취하고 자치행정을 열성적으로 임하고, 또한 청렴성이 강하여 지방토호세력이나 지방자치단체장의 친인척등과 결탁한 비리가 적다고 할 것이므로 3선까지 연임할 수 있는 것을 규정을 정비할 필요가 있는지 검토한다. 또한 지방자치단체장에 의한 자치권을 실질적으로 보장하기 위해서는 주무장관이나 감사원에 의한 감사를 할 것이 아니라 지방분권차원에서 광역지방자치단체에 광역지방자치단체장과 기초지방자치단체장과 독립된 지방감사원의 설치가 바람직한지 논의한다. 이와 같이 지방자치행정의 환경변화에 따른 지방차지단체장의 책임성 강화를 위하여 일본, 미국, 프랑스, 영국의 입법례를 검토하고 우리나라에 시사점을 강구한 후 지방자치단체장에 의한 책임성 강화방안을 마련함으로써 실질적인 지방자치와 자치분권이 이루어지도록 하여야 할 것이다.

영문 초록

As Korea has been implementing local autonomy for over 30 years, the issue of responsibility of Local Governments has been discussed in the focus of strengthening Autonomy and Decentralization. The crisis of regional extinction is emerging due to the low birth rate, aging population, and decreasing local population. It can be said that it is urgent to prepare an institutional mechanism to secure responsibility for environmental changes in local government administration, where the authority of local government heads and decentralization of autonomy are strengthened. It can be said that the competence and competitiveness of local governments cannot be secured without the integrity and morality of the head of local governments. After analyzing the performance of local governments' autonomy and decentralization from the Kim Dae Jung Government to the Yoon Suk Yeol Government, the necessity of strengthening the responsibility of local government heads in accordance with changes in the local government environment is reviewed. As the personnel rights of local government heads have been expanded due to the strengthening of local autonomy, the establishment of an independent personnel committee with the head of local governments will be discussed to strengthen the responsibility of local governments for their human rights. In metropolitan and provincial government heads, most people with extensive parliamentary experience and administrative experience, such as ministers of the central government, are elected rather than going to the head of a local government through the experience of the head of a local government or a local council. Local government heads who were elected for the first time will listen to residents' opinions, actively conduct autonomous administration, and have strong integrity, so there are few corruption associated with local protection forces or relatives of local government heads. To substantially guarantee autonomy by the head of a local government, it is not necessary to conduct an audit by the minister in charge or the Board of Audit and Inspection, but to discuss whether it is desirable to establish an independent local auditor with the head of a metropolitan government and the head of a local government in terms of decentralization. To strengthen the accountability of local government heads in accordance with environmental changes in local government administration, legislation cases in Japan, the United States, France, and the United Kingdom should be reviewed, implications for Korea, and practical local autonomy and autonomy should be achieved by preparing measures to strengthen accountability by local government heads.
