스웨덴 사례로 본 경비원의 바디캠 사용 논의

국문 초록

바디캠은 경비원이 신체에 착용 또는 휴대하여 근무 중 근거리에서 영상 및 음성으로 기록할 수 있는 기록장치 또는 그 밖에 이와 유사한 기능을 갖춘 기계장치를 의미한다. 일반적으로 경비원의 가슴이나 어깨에 부착되어 현장 상황을 실시간으로 녹화하며 일부 모델은 음성만을 기록하거나 GPS 기능을 통해 위치 정보를 제공한다. 이 장치는 현장 상황을 실시간으로 기록하고 전송할 수 있도록 설계된 장치로 녹화된 데이터는 암호화되어 저장되며, 데이터 조작을 방지하기 위한 보안 기능도 포함되어 있다. 이런 장점을 활용해 스웨덴에서는 주민보다는 경비원의 보호와 안전 그리고 근무환경 개선을 위해 바디캠을 활용하고 있다. 스웨덴 경비업체는 경비원을 대중(고객)으로부터 보호하고 그들의 근무 환경을 개선하기 위한 장비로 바디캠의 도입과 사용을 정당화했다. 이 정당성의 법적 근거를 유럽연합의 「일반 개인정보 보호 규정」 제6조 제1항 6호 정당한 이익에서 찾았다. 즉 경비업체는 경비원의 안전과 근무 환경의 개선을 위해 개인정보 주체의 동의 없이도 바디캠을 사용하여 개인정보를 처리할 수 있다는 것이다. 여기서 스웨덴의 바디캠 지급 및 사용 사례는 기존의 미국적인 맥락과는 상당히 다른 경우라고 할 수 있다. 이와 관련하여 우리나라에서도 갑질 및 폭언·폭행 관련 범죄 또는 산업재해의 피해자로서 경비원의 문제가 사회적인 이슈가 되고 있는 가운데 경비원에 대한 바디캠 지급 및 사용에 대한 논의를 전개할 시점이라고 판단된다. 따라서 이 연구는 경비원의 범죄피해 예방 및 근무환경 개선을 위해 바디캠을 지급하는 방안을 모색하기 위한 법적 근거와 문제점들을 살펴보았다.

영문 초록

A Body-Worn Camera refers to a recording device or similar equipment designed to be worn or carried by security guards, enabling video and audio recording of nearby events during their duties. Typically attached to the chest or shoulder, these devices record real-time site conditions, with some models capable of audio-only recording or providing GPS-based location data. Designed to record and transmit field conditions in real time, the data captured is encrypted and includes security features to prevent tampering. Leveraging these advantages, Sweden employs Body-Worn Cameras primarily to protect security guards and improve their working conditions, rather than focusing on the public's surveillance. Swedish security companies justify the adoption and use of Body-Worn Cameras as a measure to security guards from customers and enhance their work environment. The legal justification for this is based on the “legitimate interests” provision in Article 6(1)(f) of the EU General Data Protection Regulation (GDPR). This implies that security companies can process personal data using Body-Worn Cameras without the consent of the data subjects if it serves the purpose of improving the safety and working conditions of their personnel. The Swedish case represents a notable departure from the predominantly American context for Body-Worn Cameras use. In South Korea, issues such as workplace abuse, verbal and physical assaults, and industrial accidents involving security guards have emerged as significant social concerns. Against this backdrop, it may be time to discuss providing them with Body-Worn Cameras. Therefore, this study aims to explore the legal grounds and potential issues involved in providing body cameras to security guards as a measure to prevent crimes against them and improve their working conditions.
