해상마약 판례(태안 해상 코카인 100kg 운반사건) 평석 - 향후 해상마약 수사에서 유의점

국문 초록

국내 마약사범은 2022년 18,395명, 2023년 27,611명 등 폭발적으로 증가하고 있고, 정부는 권역별 마약범죄 특별수사본부 설치, 공항 마약 검색 강화 등 단속과 수사를 강조하고 있다. 현재 해상에서 발생하는 마약 사건 비율이 높지는 않으나, 대한민국은 삼면이 바다로 둘러싸여 있는 점, 해양이 대체 마약 운송 루트로 활용될 가능성 등을 고려할 때 리딩 판례를 토대로 향후 수사 과정에서 유의할 점을 점검하고 제도 개선 방향을 검토할 필요성이 있다. “2019년 태안 해상에 정박해 있는 외국 국적 선박에서 코카인 약 100kg을 압수하고 일등항해사를 기소한 사례”에서 법원은 1) 통역 내용을 신뢰하기 어려운 점, 2) 소변, 모발, 압수한 휴대폰 등에서 마약 관련 증거가 발견되지 않는 점 등을 이유로 무죄를 선고하였다. 해상 마약 사건에서 유사한 문제가 반복되는 것을 방지하기 위하여 수사기관과 법원에 산재되어 있는 통역인의 통합관리, 통역 인증제 확대 등을 통해 통역 자원의 양과 질을 늘리고, 이온스캐너 등 현장에서 신속히 마약을 검출할 수 있는 도구 보급에 힘써야 한다. 또한, 선주에 마약 반입 예방을 위한 보안 의무 부과, 선박 압수 규정 신설, 국제공조 활성화 등 전방위적인 노력이 수반되어야 한다.

영문 초록

The number of drug-related offenses in South Korea has surged dramatically, increasing from 18,395 offenders in 2022 to 27,611 in 2023. In response, the government has intensified efforts to combat drug crimes by establishing regional task forces and enhancing drug inspections at airports. Although maritime drug cases currently represent a smaller proportion of overall drug-related crimes, South Korea's geographical location- surrounded by seas on three sides-makes its waters a potential alternative route for drug trafficking. Therefore, it is necessary to review leading cases to identify implications for future investigations and consider possible improvement measures. In the “2019 Case of Cocaine Transportation in Taean,” where approximately 100 kilograms of cocaine was seized from a foreign-flagged vessel anchored off the coast and the first mate was prosecuted, the court rendered a verdict of acquittal. The decision was based on two key factors: (1) the lack of credibility in the interpretation of the suspect’s statements and (2) the absence of drug-related evidence from urine and hair samples, or confiscated mobile phones. To prevent similar issues in future maritime drug cases, it is crucial to enhance the management of interpreters by integrating interpreter resources across investigative and judicial agencies and expanding interpreter certification systems to improve both quantity and quality. Additionally, instant drug detection tools such as ion scanners should be distributed for field investigations. Broader measures, including imposing security obligations on shipowners to prevent drug smuggling, establishing regulations for ship seizures, and fostering international cooperation, must also be implemented.
