인공지능 관련 법적 쟁점에 대한 체계적 문헌 고찰

국문 초록

본 연구는 인공지능(AI) 관련 법적 쟁점에 대한 최근의 연구 경향을 정량적 방법과 정성적 방법을 모두 활용하여 분석 및 파악해 보고, 추후 이와 같은 연구에 대한 하나의 방법론 제시하는 데 의의가 있다. 이를 위해, 본 연구에서는 인공지능 및 관련 법적 쟁점에 관한 최근 출판된 문헌들을 체계적으로 검토하여, 인공지능 관련 법적 이슈가 형성되어 온 경과와 주요 쟁점을 분석하였다. 파이썬(Python) 프로그램을 활용하여 주제어 클라우드 분석 및 네트워크 분석을 실시한 결과, 시간의 흐름에 따라 주요 연구 주제가 변화함을 확인할 수 있었다. 또한, 인공지능 관련 법학 연구 경향을 의미론적으로 분석하기 위해 각 연구를 군집화하여 분석한 결과, ‘인공지능과 법철학적･법사회학적 담론지형 변화’, ‘인공지능과 헌법’, ‘인공지능과 민사법’, ‘인공지능과 형사법’, ‘인공지능과 행정법’, ‘인공지능과 지식재산권법’, ‘인공지능 거버넌스 및 윤리’, ‘인공지능과 법경제학’, ‘인공지능 리걸테크, 법정보학/법생태계’ 등 총 9개의 군집이 도출되었다. 인공지능의 출현은 인공지능 행위에 대한 민･형사적 책임소재의 결정, 인공지능 발명 및 저작에 대한 권리자 결정 문제 등을 중요한 법적 쟁점으로 부각시켰으며, 이와 관련된 법 규정 체계 및 시스템의 패러다임 변화가 시급함을 보여주고 있다. 즉, 연구의 분석에 따르면, 인공지능 기술의 발전으로 강한 인공지능과 정교한 로봇의 등장이 예견되는 시점에서, 인간 중심으로 구조화된 기존의 법률 시스템에 대한 재검토가 다양하고 광범위하게 이루어지고 있음이 발견된다. 결과적으로, 본 연구의 분석 결과는 인공지능으로 인해 법이 변화를 요구받고 있다는 사실을 재확인해 주고 있으며, 향후 인공지능에 대한 규율과 관련하여 법리적으로 보다 근원적인 분석과 학제간 총체적 연구가 필요함을 시사한다.

영문 초록

This study aims to analyze and identify recent research trends concerning legal issues related to artificial intelligence(AI) by employing both quantitative and qualitative methodologies, and to propose a methodological framework for future studies in this field. To this end, a systematic review of recently published literature on AI and related legal issues was conducted to examine the evolution and major areas of contention in this field. Using Python-based keyword cloud analysis and network analysis, the study revealed that key research topics have shifted over time. Furthermore, in order to semantically explore trends in AI-related legal research, the studies were clustered, leading to the identification of nine thematic groups: (1) Changes in Legal Philosophical and Socio-Legal Discourse on AI, (2) AI and Constitutional Law, (3) AI and Civil Law, (4) AI and Criminal Law, (5) AI and Administrative Law, (6) AI and Intellectual Property Law, (7) AI Governance and Ethics, (8) AI and Law & Economics, and (9) AI LegalTech, Legal Informatics, and Legal Ecology. The emergence of AI has posed significant legal challenges, including the attribution of civil and criminal liability for AI actions and the determination of rights holders for AI-generated inventions and creations. These developments highlight the urgent need for paradigm shifts within existing legal frameworks. The analysis reveals that, with the anticipated advancement of strong AI and sophisticated robotics, a fundamental and widespread reassessment of human-centered legal systems is already underway. Consequently, the findings reaffirm that the evolution of AI necessitates transformative changes in law and underscore the need for more fundamental legal analysis and interdisciplinary, comprehensive research on the regulation of AI.
