국문 초록

본 연구는 부동산물권 변동의 공시제도에 대한 기본적 이론을 분석하고, 성립요건주의와 대항요건주의를 취하고 있는 대표적 국가들의 법제에 대한 고찰을 통해 우리나라 공시제도의 현황과 문제점을 파악하여 그 개선방안을 탐색하는 데 목적이 있다. 비교법적 분석결과 독일과 스위스 등 독법주의 국가들에서는 물권변동에 관하여 성립요건주의와 공신력을 인정하는 입법태도를 취하는 반면, 프랑스와 일본 등 불법주의 국가들은 대항요건주의와 공신력 불인정 입장을 취하고 있는 것으로 나타났다. 그러나 우리 민법은 이러한 국제적 입법경향과 다르게 성립요건주의를 따르면서도 공신력을 인정하지 않는 지극히 어색하고도 이례적인 입법태도를 취함으로써 거래의 신속과 안전에 여러 문제점을 야기하고 있다. 따라서, 부동산물권 변동에 관한 모순된 입법체계를 개선하고 거래안전을 보호하기 위해서는 법률행위 및 법률의 규정에 의한 부동산물권 변동에 대해 등기의 공신력을 인정하는 것으로 민법을 개정할 필요가 있다.

영문 초록

This study is aim to identify the current status and problems of the public notice system in Korea, and to explore ways to improve it. For this purpose, it analyzes the basic theory of the public notice system for real estate property rights changes. This study also examines the legislative systems of representative countries which adopting the prerequisite and the counter-requisite principle. The comparative legal analysis shows that countries choosing a legislative attitude of prerequisite principle tend to recognize credibility regarding real estate rights changes. On the contray, the countries adopting a counter-requisite principle have a tendancy to deny credibility. Nevertheless, our civil law, unlike this international legislative trend, adopts an extremely unusual legislative attitude that follows the prerequisite principle while not giving credibility. This awkward system has caused various problems in the speed and safety of real estate transactions. Therefore, it is necessary to revise the civil law to recognize the credibility of registration for real estate property rights changes. This reforming may contribute to improvemrnt of the contradictory legislative system and protection of transaction safety of real estate.
