국문 초록

The rapid development of AI-driven autonomous driving technology has introduced novel factors that may constitute traffic accident liabilities. Traditional criminal law theories on the subject determination and objective inculpation in crime of causing traffic casualties face challenges in adapting to the perspective of intelligent driving. This paper distinguishes between autonomous driving technology as a tool versus a potential criminal subject, reconstructs the traditional framework of crime of causing traffic casualties, and explores the criminal liability of weak AI and strong AI systems in such offenses. By revisiting the principles of objective inculpation theory, the study reallocates liability for traffic accidents under different levels of human-machine interaction or full automation, providing theoretical advantages and practical references for clarifying the criminal responsibility of various actors involved in autonomous driving-related traffic accidents.

영문 초록

人工智能驱使的智能驾驶技术发展迅速,催生了可能成为交通肇事的新因素。在传统领域刑法中,交通肇事罪的主体界定与客体归罪的相关理论在智能驾驶领域可能不再完全适用。为探讨智能驾驶系统的刑法可罚性,本文对智能驾驶技术作为工具抑或犯罪主体进行了区分,通过对传统交通肇事犯罪的重新构建来探讨强弱人工智能作为参与此类犯罪主体的情形。最后回归客观归罪视野,对“人机交互阶段”与“完全自动化”不同人工智能干预下的交通肇事责任进行重新分配,为明晰智能驾驶技术对于交通肇事罪不同责任主体刑事责任的议题提供了一定的理论优势和参考价值。
