Legal Issues Regarding China's Opening up of Coastal Traffic for Foreign Vessels

Recently, the Ministry of Transport issued a notice on the continuation of the pilot policy for non five-star flag international shipping vessels' coastal traffic services by overseas international container shipping companies, and continued to implement the expanded pilot opening of coastal traffic services.This study aims to provide a reasonable legal explanation and support for the open-up policy. By using the methods of conceptual analysis and specification analysis, guided by problems, and combined with the analysis of official documents on China's policy of opening up coastal traffic, this paper elaborates on the basic concepts and characteristics of coastal traffic and the principle of reciprocity. Research has found that as an exclusive coastal transportation service, it’s allowed for openness to the foreign company under the current legal system. However, the principle of openness policy should comply with the law, and in the absence of legal provisions, the principle of reciprocity can be followed. On this basis, this study proposes that it’s useful to strictly interpret the principle of equivalence and improve the applicability, including adding “the country or region where the actual operator of the ship is located” as a condition for application and clarifying the “degree of equivalence” in the principle of equivalence. These findings are of great significance for addressing potential issues in the implementation of open-up policies and the application of the Civil Code (Contract Edition).

영문 초록

近期，交通运输部发布关于延续境外国际集装箱班轮公司非五星旗国际航行船舶沿海捎带业务试点政策的公告，继续实施沿海捎带扩大性试点开放。本研究旨在为该开放政策提供合理的法律解释和支撑。通过概念分析法和规范分析法，以问题为导向，结合对中国沿海捎带放开政策的规范性文件的分析，阐释沿海捎带及对等原则的基本概念和特点。研究发现“沿海捎带”作为一种专属性的沿海运输业务，在现行法律体系下存在对外开放的空间，但开放政策原则上可以应符合法律，在法律未规定时可遵循对等原则。在此基础上，本研究提出了严格解释对等原则并完善对等原则适用条件的建议，包括增加“船舶实际经营人所在国家或地区”作为适用对等原则的条件和明确对等原则中的“对等程度”。这些发现对于开放政策实施过程中的潜在问题以及《民法典》(合同编）适用问题的解决具有重要意义。
