헌법 관점에서 본 ‘서울대학교 인권헌장(안)’의 문제점

국문 초록

2020년 서울대학교에서 인권헌장의 제정 움직임이 있었다. 이때 제안된 인권헌장(안)은 포괄적 차별금지법의 서울대 버전이라 할 수 있다. 인권헌장(안)은 향후 서울대 교내규범으로서 그 실효성을 확보하기 위해 보다 실질적인 구제수단과 절차를 마련할 것으로 보인다. 향후 그 실효적 구제수단과 절차를 인권헌장 내에 둘 수도 있고, 다른 규정 또는 새로운 규정에서 이를 포함할 수도 있다. 나아가 서울대 인권헌장은 대한민국의 다른 대학교에 영향을 미칠 것이라고 본다. 그런 점에서 서울대 인권헌장의 제정은 일종의 「기획입법」이라고 볼 수 있다. 따라서 인권헌장(안)에 내재된 우려와 위험성을 명확히 하고 그 대책을 강구하는 것이 절실히 요청된다. 서울대 구성원, 특히 학부생과 대학원생의 권익을 보호하기 위한 것은 당연히 필요하다. 이를 위해 기존의 미비한 규정을 보완하고 구체화하여야 할 것이다. 그런 점에서 현재 추진하고 있는 「서울대학교 대학원생 인권지침(안)」의 제정은 필요하다고 본다. 다만, 논란이 되고 있는 차별금지사유로서의 성적 지향 및 성별 정체성은 배제하고서 말이다. 또한 사실상 교내 인권규범으로 존재하는 현행 인권센터 규정에 필요한 권리목록을 추가하는 방안도 고려할 수 있다. 만약 “기본적·최소한의 학내 인권기준”으로서 인권헌장이 필요하다고 한다면, 학문공동체로서 서울대 구성원이 공감할 수 있는 사항을 중심으로 구성되어야 할 것이다. 특히 성적 지향과 성별 정체성과 같은 도덕적 판단의 대상이 되는 사항을 차별금지사유로 두는 것이나 괴롭힘과 같이 불명확한 개념은 피해야 할 것이다.

영문 초록

In 2020, Seoul National University(SNU) sought to enact a human rights charter. At this time, the proposed Human Rights Charter draft can be a SNU version of the Comprehensive Anti-Discrimination Act. As a cmapus norm, the Charter is expected to provide substantive remedies and procedures to ensure its effectiveness. It can be placed in the Charter of Human Rights and can be included in the other existing provisions or new regulations. The SNU Charter affects other universities in Korea. The enactment of the Charter of Human Rights at SNU can be seen as a “planned legislation”. Therefore, it is necessary to clearly understand the dangers hidden in the Charter and take the countermeasures to eliminate them. The interests of members of SNU, especially undergraduate and graduate students, must be protected. For this reason, it is desirable to supplement and embody the current imperfect provisions. It is necessary to enact the “Guidelines for Human Rights of Graduate Students at Seoul National University”. However, sexual orientation and gender identity must be excluded as grounds of discrimination. In addition, more rights can be added to the provisions of the current Human Rights Center Regulation which is the school norm of human rights. If the Human Rights Charter is necessary as a “basic minimal human rights standard”, the contents must be composed of the things with which members of Seoul National University can sympathize with. Things that are disputable morally such as sexual orientation and gender identity must not be stipulated as discriminatory grounds
