강제된 동의, 강요된 관계: 교제폭력 피해자의 경험을 통해 본 강압적 통제의 메커니즘과 자유 탈환을 위한 여성 행위성

국문 초록

본 연구는 결혼하지 않은 친밀한 파트너 관계에서 발생한 폭력, 소위 교제폭력 피해자의 경험을 중심으로 파트너가 행사하는 폭력 속에서 강압적 통제가 작동하는 양상과 그 의미에 대해 분석하고, 향후 교제폭력 대응의 방향에 관해 모색하고자 하였다. 이를 위해 결혼하지 않은 친밀한 파트너로부터의 폭력 피해 경험이 있는 여성 10명에 대한 심층면접을 진행하였다. 분석 결과 교제폭력 피해는 아내폭력 피해와 유사하게 고립과 통제로부터 출발하고 있었다. 다수의 가해자들은 여성혐오적 가치관과 태도를 가지고 있었고, 젊은 연령대의 피해자들은 친밀한 남성 파트너로부터 성적 학대에 가까운 폭력 피해를 경험한 경우가 많았다. 연구참여자들은 가해자의 보복에 대한 공포와 이별하지 못할 것이라는 절망과 무력감을 경험하였고, 여기에는 폭력을 인식하기 어렵게 하는 ‘친밀성’의 맥락과 피해자의 약점과 특성을 공략하여 어떻게든 ‘동의’의 형식을 취하고자 하는 가해자의 전략이 존재한다. 통제관계의 강압적 지속과 피해자의 공포에 대한 이해 부족은 안전이별의 방법과 시기를 모색하는 피해자의 노력을 마치 폭력적인 가해자의 곁에 ‘자발적으로’ 머무르고 있는 것처럼 왜곡시키고, 그 속에서 ‘왜 가해자를 떠나지 않는가’, ‘왜 도움을 요청하지 않는가’라는 오래된 질문은 다시금 되살아나 피해자 비난의 맥락으로 이어지고 있었다. 그러나 피해여성들은 피해자로서의 위치에만 머무르지 않고 폭력의 고리를 끊어내고, 사회가 부여한 피해자다움에 적극적으로 저항하면서, 어딘가에서 고군분투하고 있을 또 다른 피해자들에게 도움이 되길 바라는 연대의 마음을 가지고 피해자가 아닌 생존자/행위자로서의 삶을 적극적으로 살아내기 위한 노력을 전개하고 있었다. 본 연구는 교제폭력 피해의 특성을 강제된 동의와 강요된 관계에 기반한 강압적 통제의 맥락에서 분석하고, 여성들의 경험을 사회적 연대를 모색하면서 적극적으로 자신의 삶을 살아가고자 하는 주체로서의 행위성에 초점을 맞추어 살펴보았다는 점에서 의의가 있다.

영문 초록

This study aimed to analyze the patterns and significance of coercive control within the violence exerted by partners in non-marital intimate relationships, focusing on the experiences of victims of dating violence, and to explore future directions for addressing dating violence. To this end, in-depth interviews were conducted with ten women who had experienced violence from their unmarried intimate partners. The analysis revealed that the experiences of dating violence victims, like those of domestic violence victims, started with isolation and control. Many perpetrators held misogynistic values and attitudes, and younger victims often experienced violence akin to sexual abuse from their intimate male partners. The study participants experienced fear of retaliation from the perpetrator and a sense of despair and helplessness about not being able to end the relationship. This included the context of 'intimacy,' which made it difficult to recognize the violence, and the perpetrator's strategy of exploiting the victim's weaknesses and characteristics to obtain a form of 'consent' somehow. The lack of understanding of the coercive continuity of control relationships and the victim's fear distorts the efforts of victims seeking a safe time to end the relationship, making it seem as if they are voluntarily staying with the violent perpetrator. This leads to the question of why they do not leave the perpetrator or seek help. However, the women did not remain in the position of victims; they actively worked to break the cycle of violence, resisted societal expectations of victimhood, and strove to live their lives as survivors/agents, hoping to help other victims who might be struggling somewhere. The significance of this study lies in analyzing the characteristics of dating violence in the context of coercive control based on forced consent and imposed relationships and focusing on the agency of women who seek to live their lives while exploring social solidarity actively.
