국문 초록

준거-기반 내용분석(Criteria-Based Content Analysis : CBCA)은 진술타당성분석(Statement Validity Analysis : SVA)의 일부로, 진실을 말하는 사람의 진술에서 자주 발견된다고 알려진 19개 준거가 존재하는지를 확인하는 과정이다. 본 연구는 성인 성폭력 피해자 진술분석의 타당성 검증을 위해 CBCA 점수가 재판 결과(유죄 또는 무죄)를 얼마나 정확히 예측하는지, 그리고 유무죄 판별율이 높은 준거는 무엇인지를 살펴보았다. 연구결과에 따르면 CBCA 총점이 유무죄를 신뢰롭게 예측하지 못하는 것으로 나타났다. 다음으로 CBCA 하위 준거의 진위 변별력 검증 결과 논리적 구조와 여분의 세부정보는 유죄집단에서, 그리고 자기 비하 준거는 무죄집단에서 유의하게 높았다. 진술의 논리적 구조는 신빙성 평가에서 매우 중요한 가치를 지니는 것으로 나타났으며, 그 밖의 준거들은 개별 진술자의 특성과 심리상태 및 사건의 성질에 따라 달리 그 가치가 달라지기 때문에 사례 특성을 고려해 판단할 필요가 있는 것으로 확인되었다. 이러한 결과는 CBCA가 성인 성폭력 피해자 진술분석의 유용한 도구이기는 하나 SVA의 일부로 활용될 때만 가치 있을 뿐 독립적인 진위 판단도구가 될 수 없음을 시사한다.

영문 초록

Criteria-Based Content Analysis (CBCA) is part of Statement Validity Analysis (SVA), a process that checks for the presence of 19 criteria that are known to be frequently found in the statements of truth-tellers. This study examined how well CBCA scores predict trial outcomes (guilty or not guilty) and which conventions are associated with higher conviction rates in order to validate the analysis of adult sexual assault victim statements. The results showed that the CBCA total score was not a reliable predictor of guilt or innocence. Next, we examined the truth discriminatory power of CBCA subcategories: logical structure and superfluous details were significantly higher in the guilty group and self-deprecation was significantly higher in the innocent group. The logical structure of the statement was found to be of significant value in assessing credibility, while the other cues were found to be of varying value depending on the characteristics and psychological state of the individual interviewee and the nature of the case, and thus need to be judged in a case-specific manner. These findings suggest that CBCA is a useful tool for analyzing adult sexual assault victim statements, but it is only valuable when used as part of an SVA and cannot be used as a stand-alone authenticity tool.
