국문 초록

21세기에 이르러 창의력을 바탕으로 인간은 꾸준히 과학기술과 의료기술을 발전시켰다. 이러한 과학 기술과 의학의 발전은 인류의 발전과 진보의 무궁무진한 원동력이 되었다. 한편, 발전은 밝은 면만 있는 것은 아니다. 인류에 대한 새로운, 하지만 어두운 도전이라면 도전인 것이 작금의 코로나19 상황과 예기 치 못한 재난사태의 발생이다. 무엇보다도 지금 코로나19의 확산으로 인한 인명피해와 사회경제적 피해 를 최소화하기 위한 노력이 경주되고 있음에도, 코로나19의 종식의 기미는 보이지 않는 점을 생각해볼 때 인류의 과학기술적 발전이 무색하다는 생각마저 든다. 재난관리를 간단히 정의하자면, ‘위험과 위험 회피를 다루는 분야’라고 할 수 있다. 위험에는 폭넓은 문제가 포함되며, 재난관리 시스템에 포함될 수 있는 상황은 매우 방대하다. 따라서 재난관리가 우리 모두의 일상생활에 반드시 필요하며, 재난 시에만 필요한 게 아니라 일상적인 결정으로 통합되어야 한다는 기본 전제에 부합한다. 결국 재난관리를 통해 안전이 실현될 수 있다. 이러한 재난관리는 정부가 수행해야 할 핵심적인 역할과 기능이다. 재난 및 안전 과 관련된 코로나19사태와 관련된 헌법적 쟁점은 이미 많이 논의된바가 있다. 무엇보다도 자유와 생명･ 신체의 안전의 보호라는 두 개의 이익이 서로 상충하고 있으며, 피해자는 자기 자신뿐만 아니라 사회구 성원의 다수라는 점에 강력한 공익적 이유가 작동하고 있다. 이 글은 재난･위기의 대응과 관련된 미국에 서의 일반적인 논의와 우리나라 재난대응체계에 대한 시사점을 중심으로 논의하고자 한다. 이제 새로운 국가의 사회경제적 과제는 국가 혹은 제3자의 행위와 관계없이 자연재난이든 사회재난이든 개인이 처하 게 된 운명을 국가의 적극적인 행위를 통하여 부분적으로 수정하는 내용을 갖는다.

영문 초록

By the 21st century, the whole world is going through a strange change. Along with the development of human cognitive abilities, humans have steadily developed technology and medical technology. Human creativity has become an inexhaustible driving force in this development of science and technology and medicine. This development of mankind is truly a surprise. Meanwhile, a new challenge to mankind is the current Covid-19 situation and the occurrence of an unexpected disaster. Most of all, despite the ongoing efforts to minimize human casualties and socioeconomic damage caused by the spread of the Covid-19, there is no sign of the end of the Covid-19, which makes me feel that the scientific and technological development of mankind is overshadowed. A simple definition of disaster management is 'the area that deals with risk and risk avoidance'. Risks include a wide range of problems, and situations that can be included in disaster management systems are very vast. Therefore, disaster management is essential to our daily lives, and it is in line with the basic premise that disaster management should be integrated into everyday decisions, not just in the event of a disaster. In the end, safety can be realized through disaster management. This disaster management is a key role and function that the government must perform. The constitutional issues relating to the Corona 19 incident involving disasters and safety have already been much discussed. Above all, strong public interest reasons work in that the two interests of freedom, the protection of life and body safety are at odds with each other, and that the victim is a majority of the members of society as well as herself. This article aims to focus on the general discussion in the United States regarding the response of disasters and crises and its implications for the nation's disaster response system. Now, the new nation's socioeconomic task is to partially revise the fate of individuals, whether natural or social, regardless of the actions of the state or third parties, through active actions of the state.
