국문 초록

교황 베네딕도 16세 재임 당시 사제들의 미성년자 성추행 추문과 바티칸 은행의 부패와 비리가 불거지고, 가톨릭교회는 단순한 권고와 설득만으로 범죄의 결과인 피해와 추문을 회복하기 어렵다고 판단, 2021년 5월 23일 교황령 ｢하느님의 양 떼를 잘 치십시오｣(Pascite Gregem Dei)이 공포되며 교회법전 제6권인 교회 형벌이 개정되었다. 본 연구는 과거 규범과의 비교분석을 통해 입법자의 개정 의도를 살펴보기 위함이며 그 의도는 형벌의 목적인 정의 회복, 범죄인의 교정, 추문 보상을 명확히 실현하기 위한 것이다. 예를 들어 목자의 신속한 대응, 규율의 명확성 추구, 가중 처벌 강화, 죄형법정주의에 따른 구체적 형벌 명시, 범죄의 누계에 따른 처벌인 병과주의 원칙, 성직자만이 아닌 모든 신자에게까지 확대된 정직 처분, 시효 기한이 늘어난 특정 범죄, 범죄인의 죄책과 직권자의 연대성 등 형벌의 엄중함을 강조하였다. 또한 교회법적 공평을 간과할 수 없기에, 범죄인에 대한 무죄 추정의 원칙, 비례의 원칙, 범죄인을 위한 자비와 교정, 손해 보상 및 배상 강조, 금전적 보상만이 아닌 윤리적 보상까지 엄격함을 완화하는 조치도 추가되었다.

영문 초록

When Pope Benedict XVI was in office, the Catholic Church judged that it was difficult to recover from the damage and scandal resulting from the crime with simple recommendations and persuasion. When Pope Francis was in office, the Apostolic constitution「Pascite Gregem Dei」 was promulgated on May 23, 2021 and the penal law for the church (Book VI of the Code of Canon Law) was revised. This study is to examine the legislator s intention to revise through comparative analysis with past norms. Therefore the intention of the revision is to clearly realize the purpose of punishment, for the amendment of the offender, the restoration of justice and the reparation of scandal. For example, the severity of the punishment has been emphasized: Pastor’s proper and prompt measures, the vagueness doctrine, the act of aggravated punishment, the principle to impose together punishments, the suspension extended to all believers, certain crimes with an extended prescription, and the imputable criminal and the Ordinary with the solidarity. In addition, systems have been added to ease the strictness and to be applied with canonical equity: the presumption of innocence, the principle of proportionality, mercy and amendment for the offender, the compensation for damages, and ethical compensation.
