국문 초록

본고는 불교 대장경에 다양한 법과 그물의 비유를 살펴보면서, 동아시아 국법에 삼투한 ‘법망法網’의 역사연원과 철학정신을 집중 탐구한다. 연구에 기본방법은 한역 불전 원문을 해독하고 역사적 문헌자료 분석비평을 통해 논지를 추론하는 귀납적 방법이다. 따라서 논문 구성 및 전개가 일부 비슷한 내용의 단조로운 나열현상을 띠는 바, 무미건조한 사료史料에 무궁무진한 함의를 해석 음미하는 자세가 필요하겠다. 본론에 앞서 우선 불교 대장경에 다양한 그물 비유 개황을 도표로 정리 소개하고, 이어 한역 불경 본문, 경률經律 주석, 고승 법문 및 어록에 나타난 ‘법망’을 차례로 살펴본다. 다음으로 ‘범망梵網’에 주석을 통해 ‘법망’의 함의를 고찰하고, 무량수경 본문과 주석에 보이는 극락정토 ‘법망’을 집중 분석한다. 아울러 법망의 별칭 대명사인 ‘교망敎網’과 ‘승망僧網’, 그밖에 주요한 그물 비유들도 간추려 소개한다. 본고에 가장 큰 수확은, 일반 국법의 그물 비유에 담긴 편협한 함의를 풍부하게 확대‧심화하는 불전의 ‘법망’ 해석론을 새롭게 발굴 소개함과, 그 결과 동아시아 전통법문화에서 ‘법망’의 철학정신이 훨씬 고상하고 우아한 이상경지로 앙양 승화되는 성과라 할 것이다.

영문 초록

The metaphors of the net of dharma(dharma-jāla) has a tradition of thousands of years in Buddhist Tripitaka. This article studies it esp. concerning historical origin & philosophical wisdoms of net of law in east asian legal culture. This study adopts an inductive method of corpus analysis with historical research by referring Buddhist Tripitaka records. So readers may be bored by the monotonous development of work, but would be recommended for reminding that tastelessness implies all tastes. Firstly, this work represents a summary of metaphors of the net of dharma in Buddhist Tripitaka by a chart. Secondly, it researches the net of dharma in Chinese translations of Buddhist Sutra, Chinese commentaries, and the Buddhist priesthoods & analects of great monks. Thirdly, it investigates implications of net of dharma through Chinese commentaries on ‘Brahma-jāla’(梵網: pure net). Fourthly, it looks into the metaphors of the net of dharma in Amitābhavyūha-sūtra & its Chinese commentaries. Fifthly, it traces some byname of the net of dharma, namely the net of Buddha’s teachings and the net of monks and so forth. In conclusion, this study may be rewarded with good fruits that the metaphor of the secular net of law would be able to extend and deepen its implications to saving mankind from the sea of life and death. So the spiritual wisdoms of the net of law in east asian may be uplifted by the metaphor of the net of dharma. It is wishable that the wisdom in the metaphor of the net of dharma would be invaluable reference & help to the critical development of our present legal system & culture.
