자진신고 활성화를 위한 관련 제도의 운용 방안에 관한 연구

국문 초록

독점규제법상 자진신고자 감면제도는 부당 공동행위에 참가한 사업자의 자진신고를 유인하여 규제의 실효성을 높이기 위해 고안된 제도이다. 동 제도가 제대로 기능하기 위해서는 적절한 유인체계의 설계가 중요하다. 그러나 이와 관련하여 독점규제법 위반 행위가 다른 법률에도 영향을 미치고 있다는 점도 고려되어야 한다. 특히 국가계약법 등에 규정된 부정당업자 입찰참가 제한과 같은 제재는 독점규제법상 부당 공동행위와 제도적으로 연계되어 있다는 점에서 중요하다. 독점규제법상 부당 공동행위에 참가한 사업자의 자진신고에 대한 감면이 이루어진다 하더라도, 국가계약법에 의한 제재가 여전히 가능하다면 자진신고자 유인으로서의 한계가 나타날 수밖에 없으며, 이는 동 제도의 유효성에 부정적인 영향을 미칠 수 있다. 물론 독점규제법과 국가계약법은 규범적 목적이 상이하고, 따라서 양 법률에 근거한 규제가 독립적으로 이루어진다는 것 자체를 문제 삼기는 어려울 것이다. 그러나 자진신고자 감면제도의 취지에 비추어, 독점규제법상 감면조치를 취함에 있어서 국가계약법상 이루어지는 제재가 고려될 수 있도록 하는 것은 동 제도의 실효적인 운영을 위하여 필요할 수 있다. 한편 이러한 문제의 해결을 위한 입법적 개선이 이루어지기 전이라도, 공익신고법의 적용을 통해 대체적 해결을 모색하는 방안도 적극적으로 고려될 수 있다.

영문 초록

Under the Monopoly Regulation Act, the leniency program is designed to enhance the effectiveness of regulations by enticing companies who have participated in cartel into a lawful conducts. In order for this system to function properly, the design of an appropriate induction system is important. However, it should also be considered that violations of the Monopoly Regulation Act also affect other laws. In particular, regulations such as restrictions on participation in bidding for illegitimate operators, which are stipulated in the State Contracts Act, are important in that they are systematically linked to regulation of cartel under the Monopoly Regulation Act. In light of the purpose of the leniency program system, it may be necessary for the effective operation of the system to allow sanctions imposed under the State Contracts Act to be taken into account in operating leniency program under the Monopoly Regulation Act. Meanwhile, measures to seek alternative solutions through the application of the Public Interest Reporters Act can also be actively considered, even before legislative improvements are made to resolve these problems.
