영문 초록

Since the 1990s, the number of foreign workers, marriage immigrants from the continent and other countries has increased rapidly, and the illegal social issues such as illegal stay, illegal employment, and violent crime caused by inflow from the outside have emerged as serious social issues. In May 1999, the Taiwanese government enacted ‘The Immigration Act’ to effectively manage foreigners entry and exit. Chinese nationals, Hong Kong and Macau residents apply different standards and procedures to other foreigners, and a dual management system has been established in the deportation system. In this paper, the characteristics of the deportation system were derived and the policy implications were suggested through the analysis of the legal basis of the deportation system, the organization in charge, and the enforcement procedures in Taiwan. The main characteristics and policy implications of Taiwan s deportation system are as follows: First, legislation has been realized so that deportation can be handled through legitimate legal procedures; Second, the protection of human rights and the interests of foreigners were improved during the detention period; Third, the whole of Taiwan is divided into three areas, Northern district, Central district, and Southern district, and the regional management system is established and operated; Fourth, National Immigration Agency(NIA) centered on establishing a cooperative system with other government agencies.
