국문 초록

제2차 세계대전 이후 국제형사재판은 상설재판소인 ICC를 정점으로 다수의 국제형사법원이 설립되면서 괄목할만한 성장을 이루었다. 그동안 활발하게 진행되어 온 국제형사재판은 다수의 재판소를 통해 이루어져 왔는데, 그 중 임시재판소와 혼합재판소의 역할이 매우 큰비중을 차지해 왔다. ICC와 기타 국제형사법원이 공존하고 있는 현 상황을 고려할 때 이와 같은 현상은 당분간 지속될 것으로 예상되므로 다양한 국제형사법원의 설립과 운영방식에 대해 잘 이해할 필요가 있다. 이 글에서는 임시재판소와 혼합재판소를 이야기 할 때 가장 많이 언급되는 국제형사법원일곱 개(ICTY, ICTR, 동티모르 특별패널, 코소보 혼합패널, 시에라리온 특별재판소, 캄보디아 특별재판부, 레바논 특별재판소)를 선별하여 설립 시기에 따른 법원 설립 및 운영의 변화 추세를 살펴보고 이와 관련하여 유엔의 역할이 어떻게 변화하고 있는지 확인하였다. 또한 이들 국제형사법원의 특징과 유용성을 ICC와의 비교를 통해 살펴본 후 이를 바탕으로 국제형사법원의 미래를 전망해 보았다. 그 결과 전반적으로 유엔의 역할과 지원은 점차 감소하고 법원 설립을 요청한 사건 관련국의 역할이 커지고 있음을 확인할 수 있었다. 이와 같은 현상이 나타난 이유는 ICC가 설립된 이후 새로운 임시적 성격의 국제형사법원을 설립하려는 유엔의 의지가 크지 않았고 새로운 법원의 설립은 재정적으로나 절차적으로 큰 부담이 되었기 때문이다. 그럼에도 불구하고 ICC가 설립된 2002년 이후에도 다른 국제형사법원이 계속해서 등장한것은 ICC와는 별개로 기타 국제형사법원이 가지는 특별한 기능이 있기 때문이며, 국제형사법원은 ICC를 보완하는 역할을 할 수 있으므로 앞으로도 ICC와 기타 국제형사법원은 공존할 수 있을 것으로 보인다. 따라서 향후 새로운 국제형사법원이 설립될 가능성은 충분히 있을 것으로 생각된다. 새로운 법원은 최근 변화 추세를 반영하여, 유엔과 사건 관련국 간 조약 체결을 통해 설립되고 유엔과 국가의 권리 및 의무를 재판소 규정에 명확하게 담고 있는 레바논 또는 시에라리온 특별재판소와 유사한 형태의 혼합재판소가 될 것으로 예상된다.

영문 초록

International criminal justice has developed considerably as international criminal tribunals including the ICC have been established since the Second World War. Considering the international criminal cases, greater part of the decisions have been delivered by ad hoc tribunals and hybrid courts. As co-existence between the ICC and other international criminal tribunals is expected to last for a while, it is necessary to understand well the establishment and administration of the tribunals. This article concentrates on seven international criminal tribunals (ICTY, ICTR, East Timor Special Panels, Kosovo Regulation 64 Panels, Special Court for Sierra Leone, Extraordinary Chambers in the Courts of Cambodia, Special Tribunal for Lebanon) which are the well known ad hoc tribunals or hybrid courts in order to examine developments on the establishment and administration of the courts according to the date of creation, and examine the changes on the role of the UN. Then, after comparing features and useful aspects of the ICC and other international criminal tribunals, this article describes future prospects of the tribunals. Through the examination, it has been confirmed that function and support of the UN has been decreasing and at the same time the role of the state concerned has been increasing in general. This development has been witnessed through the seven tribunals, and as the role of the UN has been diminishing, influence and burden of the state concerned has been rising gradually. The reason for this phenomenon is that the will of the UN to create a new ad hoc tribunal was not strong enough after the birth of the ICC and establishing a new one is a great burden to the UN. Nevertheless, new international criminal tribunals have emerged continuously since 2002 as these courts can play complementary role to the ICC with their special features. Therefore, it seems possible to see an emergence of a new criminal tribunal, and this one is expected to be similar to the Special Tribunal for Lebanon or the Special Court for Sierra Leone reflecting the recent developments of the international criminal tribunals. Therefore, the new court is expected to be established through an agreement between the UN and the state concerned and have the statute of the tribunal clearly specifying the rights and duties of each party.
