국문 초록

인터넷 사이트에 대해서도 저작권 침해 문제가 심각하게 제기됨에 따라 어문저작물에 대한 저작권 분쟁이 더욱 확대될 것으로 예상된다. 어문저작물의 전송이란 디지털화한 어문저작물을 이용자가 개별적으로 선택한 시간과 장소에서 접근할 수 있도 록 자신의 웹서버에 올리는 행위(uploading)와 디지털화한 어문저작물을 이메일이나 메신저 프로그램을 통하여 송신하는 것을 말한다. 저작자의 명시적 이용허락 없이 저작물을 데이터베이스로 구축하여 유료로 문헌제공서비스를 하는 것은 저작권자의 공중송신권을 침해하는 것이다. 최근 디지털환경의 발달과 함께 어문저작물은 전자책, 인터넷동영상강의 등으로 다양한 이용시장이 확보되고 있고 그 중 전자책은 e-Book, mBook, uBook 등으로 진화되고 있고 형태적으로도 e-Book외에 오디오북 등으로 새로운 시장을 열어가고 있다. 이와 같이 어문저작물의 이용시장 확보 및 시장규모 증대로 저작물을 이용하기 위한 수 요들이 발생되고 있고, 홈페이지나 이메일 등을 통한 어문저작물의 이용수요도 발생되고 있다. 그러나 디지털네트워크화 및 관련 기술발달로 인하여 전송방법에 의한 어문저작물 이용이 증가하고 있음에도 불구하고 저작물 이용방식과 관련 서비스 다양화에 부합하는 사용료 기준이 없다. 따라서 디지털 환경에서의 다양한 저작물 이용수요를 수용할 수 있는 국내외 시장의 실태 등에 기반한 전송사용료 기준 마련이 시급히 요망되고 있다. 본 연구는 우리나라 어문저작물의 전송사용료 징수 및 권리처리체제의 문제점, 관련 해외 사례와 국내의 유사사례 조사 연구 등을 통한 제도 개선 방안을 검토하고자 한다.

영문 초록

The copyright is the author s right to protect his/her works from exploitation by another person against his/her will. A person who wants to exploit another person s works must obtain authorization to exploit the works from the author, or an owner of the copyright for the works. The act of copying or transmitting by internet is not permitted without the consent of the copyright owner. Likewise, no part of a journal article, paper or electronic, can be scanned and included in a online environment without first obtaining permission from the copyright holder. We have entered the information age in which everything from text to music is being digitalized and transmitted instantaneously worldwide via the Internet. In order to respond to these rapid changes, the reasonable standards for the protection of copyrights and fair use for copyrighted materials is essential. To be able to work efficiently in the digital environment and the complex rights matrix that licensing digital uses involves, Collective Management Organizations need a effective system to keep track of the rights, their collections and distributions. This study examines the copyright problem of internet service for literary works. It also aims to suggest some solution for reasonable copyright clearance and copyright collective management.
