국문 초록

이 논문은 입법 로비활동을 입법학적 관점에서 재조명해 보고자 하였다. 사실 우리나라에서 로비활동에 대한 인식이 그다지 좋은 편은 아니다. 특히 자본과 권력에 유리한 입법․정책 결정 환경을 제공함으로써 사회적 불평등을 심화시킬 것이라는 우려가 그 핵심적인 이유이다. 그러나 실제 입법현장에서 시민단체 및 각종 이익단체 등을 제외하고도 상당수의 (대)기업 및 사경제주체들이 이미 비공식적 입법 로비활동을 수행하고 있다는 점에서만 보더라도, 입법 로비활동 등에 대한 부정적인 규범적․윤리적 차원의 인식태도가 역설적이게도 현재 수행되고 있는 입법 로비관행을 눈감아주는 결과를 초래하고 있다고 해도 과언이 아니다. 이 논문은 입법학적 관점에서 입법 로비활동을 입법논증 행위의 일환으로 이해해야 한다 고 주장하였다. 이렇게 이해할 때 국회 내 입법지원인력들이 가지는 인력 규모 및 전문성에 있어서의 한계를 넘어서서, 더욱 전문적인 입법적 논의가 이루어질 수 있다. 이를 위해서는 입법 로비활동에 대한 새로운 관점 및 제도적 디자인이 요청된다.

영문 초록

This article reconsiders legislative lobbying activity in legislative studies. As a matter of fact, reputation of lobbying act is not so positive in Korea. The main reason is that those kinds of acts constitute favorable legislative policy decision-making environment for capital and power, and accentuate inequality. However, it is no exaggeration to say that negative recognitions against legislative lobbying activity on the normative and ethical level paradoxically overlook ongoing illegal lobbying practices. Because although lobbying activity is not permitted officially many companies and interest groups actually have been lobbying. This article insists that the legislative lobbying activity should be understood as a kind of legislative argumentation activity in the line of legislative studies. In this, more professional legislative discussions can take place, beyond the actual limitations which parliamentary supporting staffs and organizations have in the aspect of size and expertise. For the purpose of this, new conceptions about lobbying activity and institutional design is required.
