국문 초록

집회ㆍ시위의 자유(freedom of assembly and demonstration)는 공동의 목적을 가진 다수인이 자발적으로 일시적인 모임을 가질 수 있는 자유 혹은 회합하거나 결합하는 자유를 말한다. 타인과의 접촉을 통하여 공동의 의사를 형성하고 형성 된 의사를 집단적으로 표현함으로써 여론형성과 정치과정에 영향을 미치는 효과적인 수단이라는 의미에서 의사표현의 자유로서의 성격도 아울러 가진다. 이것은 우리 헌법에서 보장하는 자유권적 기본권 중 하나인 동시에 민주주의를 실현하려는 사회공동체가 절대로 포기할 수 없는 객관적 가치질서로서의 성격을 가진다. 그렇지만 지금의 실제 집회ㆍ시위의 모습은 여러 유형의 갈등적 문제들이 발생할 때마다 대화와 타협을 통한 평화로운 해결보다는 집단적인 점거와 농성 그리고 폭력을 동반하여 자신의 요구를 관철하려는 모습이 나타나고 있다. 따라서 이 연구에서는 우리나라의 집회ㆍ시위 현황 및 실태 그리고 문제점을 고찰해 보고, 불법적이고 폭력적인 집회ㆍ시위 관행을 벗어나 보다 선진적인 집회ㆍ시위 문화가 정착될 수 있는 방안에 대해 논의하였다.

영문 초록

Freedom of assembly, sometimes used interchangeably with the freedom of association, is the individual right or ability to come together and collectively express, promote, pursue, and defend their ideas. The right to freedom of association is recognized as a human right, political right and civil liberty. One of the fundamental rights of the people the right of protest rally, but absolutely right for non-national security and maintain order and can limit the public welfare but also for the relative rights. However, we rally to protest at the scene less than a police line encroachments, statutory criteria, use the loudspeakers taking to the road, or even in the centre of the violence, a rally to protest excessive practicers of what is illegal. Developed countries have in the jaws of the launch in Japan of these unusual rally protests within the framework of Western developed countries the practice is legal, like you should be able to become a normal rally protesting culture will be able to make a soft landing in the developed world. The national police agency, such as the square and downtown areas from the 22th of October(except residential/school), enhanced noise standards applied the enforcement decree instituting the assembly and demonstration act. And the rest of the people with the noise excessive rallies for the damage is increasing day by day, in order to minimize the noise standards which enhanced the assembly and demonstration act enforcement to apply.
