改正不動産登記法에 관한 考察

국문 초록

부동산등기법은 민법의 부속법으로서 부동산의 표시와 권리관계를 공시하는 중요한 역할을 한다. 이번 개정으로 2011년 10월 13일부터 시행되고 있는 부동산등기법은 1960년 1월 1일부터 반세기를 넘게 기본구조를 유지하면서 20여 차례의 개정을 해왔는데, 이번 개정은 그간의 종이등기부제도를 전산등기부제도로의 대전환을 이루었다는데 특징이 있다. 정보기술의 첨단화 일상화에 맞추어 등기신청에서부터 등기를 마치는데까지의 절차가 전산정보처리조직에 의하여 이루어지고 등기부 등 초본의 발급도 전산화되어있다. 이번 개정의 구체적인 주요내용으로는 ① 등기의 효력발생시기의 명문화 ② 가등기에 의한 본등기 절차의 보완 ③ 예고등기제도의 폐지 ④ 구분건물의 표시에 관한 등기관의 실질적 심사권의 폐지 등을 들 수 있다. 이들 중에서 등기의 효력발생시기의 명문화는 긍정적이라 하겠고, 구분건물의 표시에 관한 등기관의 실질적 심사권의 폐지는 부정적이라 하겠다. 앞으로 보완해야 할 주요사항으로는 등기의 진정성과 안전성의 확보를 위한 등기원인 증서 등의 공적인증제, 등기관의 실질적 심사권의 확대 강화하는 방안을 제도화할 필요가 있고, 등기부의 안전유지와 등기기록의 위조 변조를 막는 보안조치의 철저가 요구된다. 등기의 진정성과 안전성의 확보는 등기의 공신력을 인정하는 전제가 되기 때문이다.

영문 초록

The Real Property Registration Act, as an adjective law of Civil Law, plays a major role in public disclosure of right relation of a real property. The most recently revised Real Property Registration Act becoming effective in 13 October 2011, of which the original act had been in force since 1 January 1960 and revised more than 20 times maintaining the original structure and system for over half a century, is characterized by a great transformation from the past paper-based registration book to existing computerized registration book. In summary, according to the modernized and generalized information technology, not only the registration procedure from the application to completion of a registration is performed by computerized registration information processing services but also the issuance of a certified copy and abstract of register is computerized The main contents of this revision are as follows: ① stipulation of the effective date of a registration, ② complementing principal registration procedure by provisional registration, ③ abolition of notice registration system, ④ abolition of substantial screening right of register official concerning the expression of a partitioned building, etc. Among the above revised contents, the author thinks the ① is an affirmative revision but the ④. In my opinion, to secure authentification, safety and public confidence of public notice systems of real estate information, the following details should be more improved in the future: ① public certification system of a deed of grounds for registration to secure authentification and safety of real property registration, ② institutionalization and reinforcement of substantial screening right of register official, and ③ reinforcement of security measure to maintain safety of a registration book and prevent falsification of the registration record.
