국문 초록

기술적ㆍ경제적인 발전으로 인한 국제사회의 세계화 현상은 이른바 ‘범죄의 광역화 현상’과 사람의 자유로운 이동에 따른 다양한 신종 범죄의 양상 및 불법적 비정부조직에 의한 국제 무질서 현상 등 부정적인 국제 사회의 문제를 양산하고 있다. 국제성 범죄는 최근 국제사회의 급격한 변화와 함께 그 변화양상이 더욱 가속화되고 있으며, 점차적으로 교묘화ㆍ지능화 되고 있다. 이러한 국제성 범죄에 효과적으로 대처하기 위해서는 다음과 같은 부분들이 바탕이 되어야 한다. 첫째, 각 정보기관 간의 정보공유체제가 강화되어야 한다. 9/11 테러사건 이후 선진 각국의 정보보안 기관들이 직무전문성과 효율성을 향상시키기 위하여 조직통합과 재정ㆍ인원 확대를 도모하고 있는 현 시점에서 우리나라도 국가안보를 위협하는 국제성 범죄에 대하여 사안별로 통합된 정보협력기구를 운영하여 정보기관들 간의 정보공유와 긴밀한 협력체제가 자연스럽게 이루어질 수 있도록 하여야 할 것이다. 둘째, 국제성 범죄에 대한 국제적 협력의 강화가 이루어져야 한다. 국제화ㆍ개방화에 따른 범죄의 국제화ㆍ탈국경화 현상이 심화됨에 따라 국가 간의 긴밀한 협조 없이 한 국가의 노력만으로는 국제성 범죄에 효과적으로 대응하기 어렵기 때문에 국제적 협력을 강화하여야 한다. 이러한 국제적 협력을 강화하기 위해서는 신속한 공조절차의 확립과 협력 절차의 간소화로 국제성 범죄를 사전에 예방하는 것이 필요하다. 마지막으로 정보기관의 국제적 활동능력을 배양하여야 한다. 국제성 범죄와 관련되는 정보기관들은 국제성 범죄를 적극적으로 대처하기 위하여 지속적이고 체계적인 교육으로 전문능력을 배양하여야 할 것이다. 또한 우수한 교수요원을 확보하여 국제성 범죄에 효과적으로 대처할 수 있는 양질의 교육을 받을 수 있도록 하여야 한다.

영문 초록

The globalization phenomenon in the international communities caused by technological and economic development leads to an array of negative international problems including a variety of novel crimes associated with what is called "criminal broadening" and people's free migration and international disorder brought about by illegal non-government organization International crimes are going through drastic transformation due to rapid changes in the recent international society, and getting cleverer and more intelligent. The following suggestions are made so as to effectively cope with international crimes. Firstly, the information sharing system should be reinforced among intelligence agencies. Now that the intelligence security agencies in developed countries are seeking to merge organizations, and to expand their finance and staff in order to improve their job specialty and efficiency after 9.11 terrorism attack, Korea should mangage cooperative intelligence agencies merged by issue and build a closer cooperative relationship among themselves in a natural way in terms of information sharing as a vehicle for coping with international crimes threatening national security. Secondly, international cooperation should be consolidated as a means of dealing with international crimes because it is almost impossible for a nation alone to effectively cope with international crimes without a close cooperation among nations on account of the internationalization and delocalization of recent crimes related with globalization and openness. In this context, procedures for rapid mutual assistance should be established with cooperative procedures simplified with a view to preventing international crimes in advance. Last, the internationally active abilities of intelligence agencies should be cultivated. Intelligence agencies linked to international crimes should improve their special competence to aggressively cope with international crimes with the help of continuous and systematic education. In addition, excellent teachers should be secured in an effort to provide intelligent agents with high-quality training and education so that they can effectively deal with international crimes.
