국문 초록

  신용장은 무역결제제도에서 가장 중요한 도구 중의 하나이다. UCP는 신용장을 이용하는 데 따른 전반적인 통일규칙으로, 은행의 서류검토와 그에 따른 대금지급에 관련된 내용으로 구성되어 있다. 1933년 UCP가 제정된 이후 2007년 7월 1일에 여섯 번째 개정된 UCP의 발효를 목전에 두고 있지만, 이 제도의 중심에 있는 은행과 더불어 신용장 이용당사자인 수출입업자들의 신용장 사용이 지속적으로 감소하고 있다. 여섯 차례의 개정이 있었지만 UCP의 은행면책에 관한 규정내용의 변화가 없다는 점은 많은 의문점을 자아내게 한다. 이 면책규정은 신용장제도의 운영에 있어서 그 중심적인 역할을 하고 있는 은행을 보호하기 위한 조항으로 신용장제도의 원활한 운영과 활성화에 기여 할 수 있는 바, 은행면책에 관한 보다 활발한 학술적 연구가 진행되어야 할 필요성이 대두되고 있다.
  이에 따라 본 연구에서는 서류와 관련된 은행의 면책, 전송과 번역에 따른 은행의 면책, 불가항력에 대한 면책, 지시받은 당사자의 행위에 대한 면책 등에 있어서 이러한 면책 조항의 관련규정들이 어떻게 개정되어 왔는지, 그리고 면책과 관련된 관행들이 어떠했는지를 중점적으로 살펴보았다. 이를 바탕으로 UCP 600에 명시되어 있는 은행면책규정과 관련된 문제점을 살펴보고 이에 대한 몇 가지 개선방안을 도출하였다.

영문 초록

  This study amis to review of the disclaimers of bank on the UCP and find out the solution of the problems, which might be diminished of the letter of credit"s utilization in its recent world trade settlement field. The UCP 600 approved at the Banking Commission meeting of ICC at the end of October 2006, finally it will comes into effect this 01 July 2007. As you know, there has been a little bit changed since the first time which the UCP was created by International Chammber of Commerce.
  But through this study, I want to insist that as follows,
  First, in the Article 34, disclaimer on effectiveness of documents, there is needed to interpolate the rule of fraud exception and then this will be give to users some relief to use the letter of credit. Secondly, e-nego should better be used as soon as possible to improve the efficiency of the documents examinations, that will be eliminated the argue of the discrepance, which is main cause of the unpaid and/or argument at the banks. Third, from the Article 36, force majeure, I think "strikes and lockouts is the main concerned of the bank and should remove them from the disclaimers of bank on the UCP. Fourth, it"ll be preferred to allow that the good company to open the letter of credit. If possible it , after this, the users of the letter of credit can get better condition than before. Because that will be done to other competitors in L/C market. Finally, I insist that the parties of L/C should raise a common fund to protect the loss and damage which might be happen to the disclaimers of bank on the UCP.
