한국 특수교육 입법정책의 변천에 관한 연구

국문 초록

이 연구는 한국 특수교육 입법 정책의 변천과정을 분석ㆍ검토한 후, 이를 토대로 특수교육 관련 법규의 제정과 개정의 발전적인 방향을 제시하였다. 이를 위하여 특수교육정책의 시대적 변천 과정을 개화기ㆍ일제 강점기ㆍ미군정기ㆍ태동기ㆍ안정기ㆍ발전기로 시대를 구분하고, 각 시대의 특수교육 관련 법규의 존재여부를 파악하여 그 법규의 형성ㆍ집행ㆍ평가 과정을 고찰하였다. 고찰의 대상이 된 법규는 헌법, 교육법, 교육기본법, 초ㆍ중등교육법, 초ㆍ중등교육법시행령, 특수교육진흥법, 특수교육진흥법시행령, 특수교육진흥법시행규칙, 특수학교시설ㆍ설비기준령이었다. 이 법규들의 변천과정 고찰을 통하여 우리나라 특수교육 입법 정책의 발전적 방향을 제시하였다.

영문 초록

The purpose of this research is to show the developmental direction of enactment and amendment of Korean policies for special education related law based on analysing and reviewing them (Korea policies of special education related law). For this job, this study divided the periodical process of changes on Korea special education policies into the followings: the Civilized Nation Period(1870-1911), the Japanese Occupation Period(1911-1945), the American Occupation Period(1945-1948),the Quickening Period of Special Education Policies(1948-1976), the take-off Period of Special Education Policies(1977-1994), and the Developmental Stage of Special Education Policies(1994- ), and investigated the process of formation, enforcement and evaluation through grasping wether the special education related law or not at each period. The objects of investigation were the National Constitution, the Law of Education, the Law of Education Standards, the Law of Elementary and Secondary Education, the Enforcement Ordinance of Elementary and Secondary Education Law, the Special Education Promotion Law, the Special Education Promotion Law Enforcement Ordinance, the Special Education Promotion Law Enforcement Regulations, and the Special School Facilities and Equipment Standards Ordinance. Through investigating the process of changes of these kinds of laws in Korea, there was presented the developmental direction of special education related law.
