한국군의 군대내 인권교육에 대한 개선방안 고찰

국문 초록

본 연구의 목적은 지난 20여 년간 군대에서 장병들을 대상으로 인권교육을 시행한 결과 나타나고 있는 부작용 사례를 살펴보고, 개선방안을 제시하는데 있다. 장병들과 직접 접촉이 제한됨에 따라 최근 5년간 발표된 연구 자료와 언론보도 자료를 활용하여 부작용 사례를 수집․분석하고 개선방안을 제시하였다. 연구결과 인권교육을 통해 장병들의 인권 감수성이 크게 향상되는 성과를 거두었으나, 인권보장을 주장하며 교육훈련을 거부하거나 열외하고, 상․하급자간 위계질서를 약화시키며, 허위 사실을 제보해서 상급자에게 피해를 주는 등 다양한 형태의 부작용도 동시에 발생하고 있는 것으로 나타났다. 장병들의 인권을 보장하면서도 엄정한 명령 복종체계가 유지되는 군대로 육성하기 위해서는 인권교육용 교재 내용에 군대조직의 특성․군인의 책임과 의무 부분을 추가하거나 확대 편성하고, 대대급 부대에 마음의 편지 심의위원회를 설치하여 허위제보를 방지해야 하며, 지휘관․전문상담관들의 업무평가시 인권교육 참석 횟수를 평가요소로 반영하고, 상급부대 회의시 참석자에 대한 인권교육을 의무화 시켜야 한다.

영문 초록

The purpose of this study is to examine the side effects that are appearing as a result of human rights education in the military over the past 20 years and to suggest improvement measures. Research data and media press data published over the past 5 years were used. As a result of the study, human rights sensitivity of soldiers has been greatly improved through human rights education, but side effects are also occurring, such as refusing education and training, weakening the hierarchy, and damaging superiors by reporting false facts. In order to guarantee the human rights of soldiers and foster them as a strong military, the characteristics of military organizations and the responsibilities and duties of soldiers should be added or expanded to the contents of human rights education textbooks, a “Mind Letter” review committee should be established in the battalion-level unit to prevent false information, the number of human rights education attendance should be reflected as an evaluation factor when conducting work evaluation by commanders and professional counselors, and human rights education for participants should be mandatory at higher level meetings.
