숙의민주주의 제도화 가능성과 한계에 대한 연대기적 고찰: 경남학생인권조례 추진 사례를 중심으로

국문 초록

본 연구는 2008년부터 2019년까지 세 차례에 걸쳐 추진된 경남학생인권조례 제정 과정을 연대기적으로 분석하고, 각 시기의 시민참여 구조, 제도정치와의 연계, 숙의민주주의의 실현 정도, 정책 반영 및 중재 구조를 중심으로 지방정치에서 숙의민주주의의 제도화 가능성과 한계를 실증적으로 고찰하였다. 분석 결과, 제1차 과정(2008~2010)은 시민사회 주도로 정책의제가 형성되었으나, 제도정치의 배제와 숙의 구조 부재의 한계를 드러냈다. 제2차 과정(2011~2012)은 주민발의와 교육위원회 중심의 숙의 절차를 통해 시민참여가 제도권으로 진입하였고, 정보 제공과 절차적 공정성이 일정 수준 확보되었다. 교육의원제 기반의 위원회는 제한적이나마 갈등 조정자로 기능하였으나, 숙의 결과는 통합적 조율 없이 찬반 표결로 귀결되었고, 이후 제도적 반영 노력도 부재하여 한계를 드러냈다. 제3차 과정(2017~2019)은 교육청의 공적 절차와 도의회 토론회 등 숙의적 절차가 일부 제도화되었으며, 도의회의 중립적 찬반토론회 운영과 공론화, 교육위원회의 엄정 중립 및 당론 배제 운영 원칙을 통해 숙의민주주의의 실현 가능성을 보여주었으나, 교육청의 편향된 정보 제공, 시민참여의 분극화, 통합적 정책조율 부재는 숙의민주주의의 질적 심화를 제약하였다. 이러한 과정을 통해 경남 사례는 단순한 정책 실패가 아닌, 대의민주주의의 한계를 보완하는 숙의민주주의의 제도화 조건과 현실적 제약을 동시에 보여주는 경험적 자산으로 평가된다. 이는 향후 지방정치에서 갈등적 정책의제를 민주적으로 조율하고, 시민참여와 제도정치가 상호 보완적으로 작동하는 제도 기반을 설계하는 데 중요한 시사점을 제공한다.

영문 초록

This study provides a chronological analysis of the Gyeongnam Student Human Rights Ordinance (SHRO) initiative, pursued in three phases from 2008 to 2019. Focusing on the structure of civic participation, interaction with institutional politics, the realization of deliberative democratic conditions, and mutual dynamics, the research examines the potential and limits of institutionalizing deliberative democracy in local governance. The first phase (2008–2010) was led by civil society and succeeded in raising the policy agenda, but lacked institutional engagement and deliberative structures. In the second phase (2011–2012), citizen participation entered the institutional realm via a resident initiative and education committee deliberation. Though procedural fairness was partly achieved, the process ended with a binary vote and no follow-up institutional action. The third phase (2017–2019) institutionalized some deliberative procedures through the Education Office’s proposal and the Assembly’s neutral forums. However, biased information, civic polarization, and weak policy coordination hindered deeper deliberation. Rather than a policy failure, the Gyeongnam case illustrates both the enabling and constraining factors of deliberative democracy as a complement to representative democracy, offering insights into democratic institutional design for contentious policy issues.
