국제기준과 해외 제도를 바탕으로 파악한 한국 입양정보 관리제도의 문제점과 개선방안

국문 초록

본 연구는 우리나라 입양정보 관리의 문제점을 분석하고 개선 방안을 모색하는 데 목적을 두었다. 이를 위해 비교법 연구방법을 통해 국제기준과 각국의 입양 관련 법률 및 제도를 중심으로 정보 수집, 보관, 공개에 대한 입양기록물 관리제도를 조사하였다. 연구 결과, 한국 입양정보는 민간과 공공시설에 분산되어 있으며, 공식적 지침이 없는 상황에서 관리되고 있어 안전한 자료 이관 및 통합 관리의 필요성이 확인되었다. 특히, 우리나라는 정보 수집과 제공 범위가 제한적이며, 이로인해 훼손 또는 상실된 출생 정보를 잃은 입양인의 권익 보호가 미흡한 상황이다. 유엔아동권리협약과 헤이그입양협약은 입양정보 관리에 있어 아동 권리를 중심으로 엄격한 기준 마련을 권고하고 있으며, 2025년 국내입양특별법 시행을 계기로 이러한 국제적 기준을 반영한 체계적인 입양정보 관리가 이루어져야 한다. 이를 위해 입양 실무자의 전문성 강화와 아동 인권에 대한 인식 개선이 필수적이다.

영문 초록

This study analyzed issues in managing adoption records in South Korea and explore improvement measures. To achieve this, this study investig ated management systems for collecting, storing, and disclosing adoption records in various countries, focusing on adoption-related laws and systems through a comparative law methodology. The findings reveal that Korean adoption information is dispersed across private and public facilities, managed without official guidelines, and lacks secure data transfer and integrated management. South Korea’s limited scope for information collection and disclosure has resulted in insufficient protection of the rights of adoptees, particularly for those who have lost birth information due to damage or loss. The UN Convention on the Rights of the Child and the Hague Adoption Convention recommend strict standards centered on children’s rights to manage the adoption information. With the implementation of the Special Adoption Act in 2025, South Korea must establish a systematic adoption information management systems that reflect these international standards. To achieve this, it is essential to enhance the expertise of adoption practitioners and raise awareness of children’s rights.
