국문 초록

在中国船员规模接续扩大的境遇下，为妥善保护船员权益和有序进行船员管理，以 比较法中的结构主义方法同具有类似法秩序的韩国船员法规范相比较具有实然意义。通过 比较显现中国面临船员法规范欠缺高位阶单行法律和体系化构造的宏观问题与船员概念模 糊、船长职责规范片面和船员权益保护疲弱的微观问题。将更具全面、体系和成熟质性的 韩国船员法规范能动地移植融入中国船员法既有规范中并推动制立《船员法》单行法律成为 解决前述问题的有效方案。

영문 초록

Against the backdrop of the expanding scale of Chinese seafarers, in order to adequately protect the rights and interests of seafarers and carry out seafarers’ management in an orderly manner, it is of practical significance to compare the legal norms of Korea’s seafarers, which has a similar legal order, by using the structural method in comparative law. The comparison reveals that China is facing the macroscopic problems of the lack of a high-level separate law and a systematic structure for the legal norms of seafarers, and the microscopic problems of the ambiguous concept of seafarers, the one-sided norms of the master’s duties, and the weak protection of the rights and interests of seafarers. Transplanting the legal norms of Korea’s seafarers, which is more comprehensive, systematic, and mature, into the existing legal norms of China’s seafarers and promoting the enactment of a separate Seafarers Act have become effective solutions to the problems mentioned above.
