국문 초록

본 연구는 현행 참전유공자를 6·25전쟁과 월남전쟁에 참전하고 전역한 군인이나 경찰공무원으로 한정하고 있어, 국지전이나 위험작전에 참여한 장병들을 국가차원에서 지원하는 방안을 탐색하는데 있다. 이를 위해 현행 법령을 기준으로 위험작전 참여 군인의 기준과 범위를 살펴보고, 외국의 보훈제도 유사사례를 통해 적정한 지원방안을 제시하고자 하였다. 연구결과는 다음과 같다. 첫째, 위험작전에 대한 인정기준과 범위에 대해 기존 법령과 연관하여 개념 정립과 ‘참전’의 개념의 포괄적 확대가 필요하다. 둘째, 위험작전 참여자의 인정 기준을 교전과 전투지역으로 명확하게 규정해야 한다. 셋째, 보훈대상자 선정에는 정확한 실태조사를 통한 검증이 필요하다. 넷째, 위험작전이나 평시 전투 참여자의 지원방안은 현행 보훈제도와 형평성을 고려한 지원방안을 마련해야 한다. 또한 국지전이나 위험작전 참여자를 보훈정책 대상자로 포함시키는 과정에는 구체적인 법령 개정작업이 뒤따라야 할 것이다. 여기에는 국방부를 비롯하여 정부 간 협력과 함께, 국민적 지지가 있어야 성공적으로 추진될 수 있다. 따라서 국회와 정부 내 주요 행위자들에 대한 설득과 지지의 획득이 중요한 과제가 될 것이다. 이러한 정책이 성공적으로 추진하기 위해서는 보상 자체보다는 국가적, 사회적 인정이 더 중요한 문제가 될 수 있다는 점이다. 따라서 충분한 공감대 형성과 더불어 지속적인 관심이 필요하다.

영문 초록

The purpose of this study is to find ways to support the soldiers who participated in local wars or dangerous operations at the national level, as the current veterans are limited to soldiers and police officials who participated in the 25 June War and the Vietnam War. To this end, we examined the criteria and scope of military personnel participating in dangerous operations based on the current laws and regulations, and tried to suggest appropriate support measures through examples from foreign veterans' systems. The results of the study are as follows. First, it is necessary to establish the concept of recognition criteria and scope for dangerous operations in relation to existing laws and regulations, and to comprehensively expand the concept of "participation." Second, the criteria for recognition of participants in dangerous operations should be clearly defined as engagement and combat zones. Third, the selection of veterans needs to be verified through an accurate fact-finding survey. Fourth, support measures for participants in dangerous operations or peacetime combat should be prepared in consideration of the current veterans system and equity. In addition, the process of including participants in dangerous operations as subjects of veterans' policies will have to be accompanied by specific amendments to the statutes. This can only be successfully implemented with cooperation between governments, including the Ministry of National Defense, and with public support. Therefore, persuasion and gaining the support of key actors in the National Assembly and government will be an important task. In order for such a policy to be successful, national and social recognition may be more important than the reward itself.
