국문 초록

4차 산업혁명의 진전에 따라 서비스 산업도 급속하게 발전하면서 적합하고 적절한 법제도적 규율이 필요하게되었다. 기존의 법적 대응방안에 한계가 발생하면서 다양한 대응수단이 논의되고 있다. 본 연구는 서비스 자체의본질적 특성, 기능 및 평가방법 등을 고려하여 서비스 인증제도를 제안하였다. 서비스는 무형성, 생산과 소비의 동시성, 소멸성, 평가의 비계량성과 전문성을 특징으로 하는데, 서비스의 이러한 특성은 서비스를 평가하고 평가기준을 마련하는데 어려움을 준다. 서비스의 내용을 구체화하기가 어렵고, 서비스 제공 즉시 소멸하기 때문에 평가하기도 쉽지 않으며, 서비스의 비계량성과 전문성은 평가의 방법 등에 대한한계를 잘 보여준다. 서비스 표준의 제정이나 평가 등을 위해서 단체표준제도가 활용될 수 있다. 단체표준 및 인증제도는 표준의 제정 및 평가주체의 확보 등에 있어 좋은 체계를 구축하고 있다는 점에서 유용하다. 단체표준 및 인증제도를 구현할 수 있는 실증연구로써 스마트 헬스케어 서비스를 위한 표준 및 인증을 제시하였다. 기존의 서비스 표준 및 평가기준에 스마트 헬스케어 서비스에 고유한 심사 사항을 추가함으로써 충분히 제도화할 수 있을 것으로 파악된다. 향후 우리나라의 서비스산업 분야의 법제도적 규율 수단으로 서비스 단체표준 및 인증제도를 적극적으로 도입하여 산업발전 뿐만아니라 소비자의 안전과 서비스의 질적 향상 및 국제경쟁력까지도 확보할 수 있을 것으로판단된다.

영문 초록

With the progress of the 4th industrial revolution, the service industry also developed rapidly, requiring appropriate legal and institutional discipline. As the existing legal countermeasures are limited, various countermeasures are being discussed. This study proposed a service certification system in consideration of the essential characteristics, functions, and evaluation of the service itself. Services are characterized by intangibility, simultaneity of production and consumption, perishability, non-measurement and professionality of evaluation. These characteristics of the service make it difficult to evaluate the service and prepare the evaluation criteria. The content of the service is difficult to materialize. It is not easy to evaluate because it disappears immediately after the service is provided. Due to the non-measurement and professionality of the service, there are limitations in the evaluation method, etc. For the establishment of service standards or service evaluation, the collective standard system can be used. Collective standards and certification systems are useful in that they establish a good system for establishing standards and securing evaluation subjects. As an empirical study that can implement collective standards and certification systems, standards and certifications for smart healthcare services are presented. It is understood that the system can be sufficiently institutionalized by adding the unique examination items to the smart healthcare service to the existing service standards and evaluation criteria. In the future, it is judged that it will be possible to secure not only industrial development but also safety of consumer, improvement of service quality, and international competitiveness by actively introducing collective standards and certification systems as legal and institutional means of regulation in the service industry in Korea.
